GENERAL TERMS AND CONDITIONS KAPITAL 2027

EVENT: KAPITAL FESTIVAL

1. GENERAL PROVISIONS

1.1. These General Terms and Conditions (hereinafter the “GTC”) apply to the organization and running of the KAPITAL event (hereinafter the “Festival” or “Kapital”), organized by NEVERSEA PRODUCTION S.R.L., with its registered office in Cluj-Napoca, Str. G-ral Eremia Grigorescu, no. 122A, Cluj County, registered with the Trade Registry under no. J2023005035127, Tax ID: 49168377 (hereinafter the “Organizer” or “Kapital”), and set out the provisions that each participant of the event undertakes to comply with.

1.2. By purchasing a ticket or by attending the festival, the Participant declares that they have read, understood, and undertake to comply with the GTC, which also include the Privacy Policy.

1.3. The General Terms and Conditions are valid for an indefinite period. Participants agree that Kapital has the right to unilaterally amend these GTC, without prior notice to them. If the GTC are amended, such amendments take effect immediately upon publication on the Site. Kapital notes that the GTC may be amended after the purchase of the Ticket, even immediately before the Festival. Kapital recommends that Participants monitor any amendments to these GTC.

 

2. DEFINITIONS

2.1. Throughout their use in this document, the defined terms have the meaning agreed in this section, unless otherwise defined elsewhere in this document:

  1. Add-on: Additional product or service options available exclusively to purchasers of Festival tickets, allowing them to enjoy special experiences during the event (for example, backstage insider tour, backstage discovery tour, etc.).
  2. Ticket: a certificate issued in any form (on paper or in electronic form), a one-day ticket, a pass, or an invitation certifying the right to a Wristband at the Festival. Tickets are either non-nominal or nominal and carry a unique identification number. By purchasing Tickets, buyers undertake to comply with these General Terms and Conditions, the procedures for registering purchased Tickets, check-in and access rules at the Festival, as well as any other rules for participating in it that are brought to their attention through various means, including directly through the Site. Purchasing Tickets/Wristbands from areas other than those authorized by the Festival Organizer is prohibited and results in restriction of access to the relevant Festival.
  3. Premium services: additional paid services that provide facilities or differentiated experiences within the Festival (for example, access to the VIP platform, etc.), which may differentiate ticket categories.
  4. System fees: administrative, processing, and any other fees specific to the ticketing system, charged in addition to the base price of the Ticket.
  5. Festival Access: the right to enter and participate in the Festival, representing the basic component of any Ticket.
  6. Wristband: a certificate applied by Kapital upon validation of a Ticket, which grants rights identical to those included in the Ticket and — provided it remains secured in accordance with Section 3 below — exclusively certifies that its wearer has the right to visit the relevant Festival; also a special means of payment within the Festival.
  7. Ticket Buyer: the person who purchases the Ticket to the Festival.
  8. Festival Duration: the duration of any Festival, corresponding to the period of time between the start and end of the Festival. The start of the Festival corresponds to the start of validity of the tickets for that Festival authorizing the first entry to the relevant Festival. The end of a Festival corresponds to the end of validity of the Ticket authorizing the longest stay at the relevant Festival. Kapital reserves the right to organize programs or provide Services during the Festival Duration.
  9. Festival: the Kapital Festival, comprising all performing-arts programs — music, entertainment, and culture — and other free or paid Services offered by Kapital during a certain period of time and in a certain area established by the Organizer.
  10. Organizers/Kapital: Neversea Production S.R.L., with its registered office in Cluj-Napoca, Str. G-ral Eremia Grigorescu, no. 122A, Cluj County, registered with the Trade Registry under no. J2023005035127, Tax ID: 49168377.
  11. Contractual Partner: an economic operator or other natural/legal person carrying out independent commercial activities at a given Festival, based on a contractual relationship with Kapital.
  12. Participants: all persons attending the Festival.
  13. Wallet: the section of the personal account created on the platform www.kapitalfestival.com where the user finds purchased tickets, tickets available for check-in, tickets for past events, and the ability to carry out online check-in or online top-up on tickets.
  14. Product: the items and rights with pecuniary value that may be purchased from Kapital or other Contractual Partners within or in connection with the Festival, as well as any vouchers or similar means that may be offered in exchange for them.
  15. RHUNA: a multi-purpose value coupon that can be used to purchase “Rhuna products and services,” i.e., those available within the ecosystem of events and festivals organized by the companies within the Untold group, which include Massif Festival, Untold Romania Festival and Untold Dubai, Kapital Festival, and Neversea Festival. RHUNA products and services are purchased through the platforms www.bemassif.com, www.untold.com, www.untold.ae, www.neversea.com, and www.kapitalfestival.com.
  16. Rewards: benefits granted by the Organizer to customers to increase loyalty. These advantages and rewards may be used to purchase Rhuna products and services within the festivals and platforms associated with the Untold group.
  17. Service: any service made available by Kapital or its Contractual Partners within or in connection with the Festival, whether free or paid.
  18. Account Balance: the section of the personal account created on the platform www.kapitalfestival.com where the user can top up an amount of money. This amount is converted into Rhuna and may be used to purchase Rhuna products and services or to carry out an online top-up on the festival access wristband.
  19. Site: the Kapital website, namely www.kapitalfestival.com.
  20. GTC: these General Terms and Conditions governing the running of the Festival, available both on the Site (as defined above) and at all entrances to the Festival Area.
  21. Third Parties: natural and legal persons other than Kapital, Visitors, or Ticket Buyers.
  22. Voucher 2027: a product purchased by the buyer that offers the possibility of attending the next edition of the Festival.
  23. Festival Area: any of the locations where the Festival takes place.

 

3. LEGAL RELATIONSHIP

3.1. These GTC set out the obligations arising from participation in the Festival and the relationships established between Kapital and Participants in connection with the Festival, the latter being required to comply with them, the application of the GTC serving to guarantee safety and comfort.

3.2. The GTC must be read together with the Privacy Policy. The GTC will be posted both on the website www.kapitalfestival.com and at the Festival entrance.

3.3. These GTC set out the rights and obligations arising from receipt of an Order Confirmation, the purchase of Products, and participation in the Festival, and the relationships established between Kapital and the Buyer and Participants.

3.4. By purchasing Products or participating in the Festival, Product Buyers and Participants accept and agree to comply with:

  • The GTC and any obligations and responsibilities related to them. Any Product Buyer and Participant who breaches the GTC may be liable to legal action, refusal of entry to the Festival, and/or removal from the Festival premises.
  • Security measures, notices, requests, or announcements displayed or issued by the Police, Security Personnel, or agents representing any of the Associated Entities, including without limitation all instructions or announcements regarding access to and security at the Festival;
  • All national laws and regulations.

3.5. The Buyer and the Participant agree to indemnify the Organizer for any damages, losses, liability, or harm that these parties suffer or may suffer as a result of the Buyer’s and Participant’s failure to comply with these GTC.

 

4. TICKETS AND WRISTBANDS

4.1. Visitors are admitted to the Festival on the date and at the times specified by the organizer. By purchasing a valid Ticket, each Participant secures the right to attend the Festival, with the obligation to know their rights and obligations within it.

 

4.2. TYPES OF TICKETS/Passes for the 2027 Edition of the Festival

4.2.1 Participation in the Festival is done using one of the following types of Tickets:

A) Standard Pass (General Access) – guarantees the Authorized Participant access to the Festival for its entire duration.

B) VIP Pass – guarantees the Authorized Participant access to the Festival for its entire duration. Holders of VIP passes enjoy access to a specially arranged area with bars offering Premium drink options. Access to the Festival for VIP pass holders is through a special entrance.

 

Important! Access of persons under 18 to the VIP area is strictly prohibited. Contractual Partners operating the VIP platforms may set differentiated access conditions on the platform, depending on the services offered by the Partner and paid for by the consumer.

 

C) One-day Ticket – guarantees the Authorized Participant access to all Festival stages on that day, starting from the opening time announced by the Organizer until the Festival closes for that day, and for the other days the Participant no longer has access to the Festival.

D) UNDER 25 Pass – guarantees access to the Festival for its entire duration to a Participant who meets the conditions of the “UNDER 25” program.

Products under the Under 25 Program are dedicated and available only to persons who meet the following conditions:

  1. The person purchasing this pass has not turned 25 years of age on the first day of the Festival, a date to be announced by the Organizer;
  2. Is enrolled in a form of education in Romania and can prove enrollment in a form of education in Romania by presenting a document attesting to this fact (student ID, certificate, etc.) and their identity card in order to verify the person’s name and age.
  3. At the time of the festival, the pass buyer must present themselves at the point marked “Accreditations,” located within the festival, where they will collect their festival wristband directly by presenting their identity card and the student ID or certificate proving student status (the certificate must have the personal identification number (CNP) removed by any method that ensures it cannot be deciphered, for example by crossing it out with a marker).
  4. If the holder of a purchased Under 25 pass cannot prove they are eligible, they will pay the difference between the full price of the pass and the price paid for the pass under the promotion. Otherwise, access to the Festival area will not be permitted.
  5. These passes are offered under a program and are subject to available stock. Prices are displayed in the Tickets section of the website.

 

E) One for All Pass (product detailed in Annex 1)

 

4.2.2. All purchases and transactions are made exclusively through a comprehensive platform dedicated to the event. This platform integrates various payment methods and covers a wide range of costs. Without limitation, the displayed price of each product may include the following components:

• Base price – Festival access (fixed component, identical for all ticket categories)

• System fees – (administrative, processing fees, and other fees specific to the ticketing system)

• Top-up amounts – (usable within the festival), as applicable

• Premium services – (for example, access to the VIP platform, etc.)

• VAT – applied in accordance with applicable law.

 

The exact components of each product may vary depending on the buyer’s category, sales policy, and the nature of the relationship with the Organizers, and may be adapted by the Organizers.

 

4.2.3. The names of ticket categories (for example General Access, Standard, Comfort, VIP) correspond to packages that, in all cases, include the same basic Festival access component, at the same base price. The difference between categories is given by the premium services included in each package (for example, access to the VIP platform, wristband delivery), as well as by the fees and components associated with them.

 

4.3. TYPES OF INVITATIONS

4.3.1 Participation in the Festival is also possible using one of the following types of invitations (which will be treated as Tickets):

A) Standard Invitations (General Access) – guarantee the Authorized Participant access to the Festival for its entire duration, starting from the first day at the opening time announced by the Organizer until the end of the Festival.

B) VIP Invitations – guarantee the Authorized Participant access to the Festival starting from the first day at the opening time announced by the Organizer until the end of the Festival. Holders of VIP invitations enjoy access to a specially arranged area with bars offering Premium drink options. Access to the Festival for VIP invitation holders is through a special entrance.

 

Important! Access of persons under 18 to the VIP area is strictly prohibited. Contractual Partners operating the VIP platforms may set differentiated access conditions on the platform, depending on the services offered by the Partner and paid for by the consumer.

 

C) One-day Invitations – guarantee the Authorized Participant access to all Festival stages on that day, starting from the opening time announced by the Organizer until the following day at closing time, when the Ticket’s validity ends, after which the Participant no longer has access to the Festival.

D) For the 2027 Festival Edition

 

4.4. TYPES OF VOUCHERS FOR THE 2027 EDITION OF THE FESTIVAL

4.4.1. Before the festival date for the 2027 edition is announced, the Organizer will issue vouchers that will be converted into access tickets once the date of the event is announced. After that point, the vouchers will become actual tickets granting access to the festival.

Participation in the Festival is done using one of the following types of Vouchers, which will be converted into Tickets once the festival date is announced:

E) Standard Voucher (General Access) Register/Pre-sale – guarantees the Authorized Participant access to the Festival for its entire duration.

F) VIP Voucher – guarantees the Authorized Participant access to the Festival for its entire duration. Holders of VIP passes enjoy access to a specially arranged area with bars offering Premium drink options. Access to the Festival for VIP pass holders is through a special entrance.

Important! Access of persons under 18 to the VIP area is strictly prohibited. Contractual Partners operating the VIP platforms may set differentiated access conditions on the platform, depending on the services offered by the Partner and paid for by the consumer.

 

4.5. SERVICES AND ACCOMMODATION

4.5.1. Through the website, the Organizer makes available a series of products including services and accommodation, or various packages, which will be offered in collaboration with our contractual partners. Additional information on the detailed conditions applicable to the purchase of these Services will be provided by our contractual Partners at the time of purchase of the Services. Buyers of accommodation services must also comply with the rules and regulations of the accommodation venue purchased.

 

4.6. The buyer of a voucher/ticket/pass is obligated not to post images of them online.

4.7. It is strictly forbidden to sell or buy invitations.

4.8. We encourage persons entering the Festival Area using an invitation to donate an amount of money (at locations that will be indicated for this purpose), an amount to be used for charitable purposes, described at specially arranged locations.

4.9. Tickets/Invitations grant access to the Festival for a single person.

4.10. The Organizer reserves the right to change the list of artists participating in the festival, both before and throughout the event. Tickets purchased for participation in an entire event day, as well as passes, grant the buyer access to the festival area and not to a specific show/artist.

4.11. Each location within the festival area has a limited capacity, and access may be temporarily restricted in order to comply with applicable safety standards.

4.12. Standard Tickets/passes may be upgraded to VIP Tickets/passes, upon payment of a price difference, subject to available stock.

4.13. For a ticket price expressed in a currency other than RON, the reference exchange rate was set at USD 1 = 4.9786 lei as of 13.01.2025, 08:44:57, per Banca Transilvania, or EUR 1 = 5.241 lei as of 06.05.2025, 17:31, per Banca Comercială Română.

4.14. The Organizer reserves the right to change the exchange rate and the price of Tickets without prior notice. A change in ticket price does not apply to tickets already purchased at the time the change occurs.

 

4.15. Additional Add-ON services

4.15.1. Additional product or service options available exclusively to persons who have purchased a valid Festival ticket. 4.15.2. The list of available Additional Services, their description, conditions of use, and applicable prices are published on the Organizer’s official platform and may be updated without prior notice. 4.15.3. Additional Services may be purchased through the official online platform, using the payment methods accepted by the organizer. 4.15.4. The purchase is considered complete upon confirmation of payment by the payment processor.

4.15.5. Once purchased, Additional Services cannot be cancelled, changed, or refunded, regardless of the reasons invoked by the buyer.

4.15.6. Access to Add-Ons is nominal and may not be transferred to another person, except in cases expressly stated by the Organizer.

 

4.16. PAYMENT FOR PRODUCTS AND THE INSTALLMENT PAYMENT OPTION

4.16.1. Purpose. Tickets or Services may be purchased through one of the following methods, depending on the options available at the time of purchase on the kapitalfestival.com platform.

  1. Payment in full, meaning payment of the entire amount for the product in a single installment;
  2. Installment payment, which allows splitting the total amount into monthly installments, according to the customer’s choice, to the extent that this facility is made available by the Organizer for the relevant product and is displayed as available on the platform at the time of purchase. Only products expressly indicated by the Organizer on the kapitalfestival.com platform as being available for payment in this manner may be purchased in installments.

4.16.2. The customer will choose the desired payment method at the time of placing the order.

4.16.3. Installment payment mechanism. The number of installments available and their amount is indicated on the Organizer’s platform and is determined based on the time remaining until the event date and the amount paid with the first installment. When selecting the installment payment option, the customer will indicate the desired number of installments, within the available maximum. Products purchased after 1 June 2027 are not eligible for installment payment. The Organizer charges a processing fee for use of the installment payment option. This fee is 50 RON, is paid at the time the installment payment option is selected, and is included in the first installment. The processing fee is non-refundable, regardless of the reasons invoked. The Organizer reserves the right to update the amount of the processing fee, but any change will apply exclusively to future transactions and will not affect fees already paid.

4.16.4. (1) Withdrawal of amounts. The first installment will be paid at the time of purchasing the Product with installment payment. Subsequently, each installment will be automatically withdrawn from the bank card authorized by the customer on the platform, at an interval of 30 days between withdrawals. By selecting the installment payment option, the customer expressly consents to automatic debiting of installment amounts by the Organizer. The customer is required to ensure there are sufficient funds in the bank account associated with the card used to pay the installments.

  1. If an installment cannot be successfully withdrawn, the Organizer will make the following attempts: three attempts on the first due date; one additional attempt on the 3rd day; a final attempt on the 5th day. If the installment remains unpaid after these five attempts, the customer may make the payment manually through the platform. If the customer accumulates two unpaid installments, they will have access to a dedicated button to contact the support team in order to resolve the situation.
  2. If all outstanding amounts are not paid in full within 60 (sixty) calendar days from the date of the first failed debit attempt for the oldest outstanding installment, the installment payment facility for that order automatically terminates and can no longer be reactivated.

4.16.5. Access to the product. No product purchased through the installment payment option will be available for use until the amounts due are paid in full. Once payment is completed in full, the products become valid and may be used for their intended purpose. Specifically:

  1. Products purchased in installments cannot be transferred to another user, and until the amount owed is paid in full, online check-in cannot be performed, the wristband associated with the ticket cannot be delivered, and the ticket’s QR code or any other services associated with the purchased product will not be available.
  2. The customer understands and agrees that, regardless of the number or value of installments paid, installment payment is a facility conditional on full payment of the product’s price within the term and conditions set out in these Terms. If the product’s price is not paid in full, including as a result of termination of the installment payment facility under Article 4.16.4, the Organizer has the right to cancel the order. In this case, the product may no longer be used, and amounts already paid up to the date of cancellation are non-refundable, regardless of the reason full payment was not made.

4.16.6. Management platform. All payments are processed through the Organizer’s official platform, available at kapitalfestival.com. The customer’s banking data is protected by security measures in line with industry standards. The Organizer reserves the right to change the installment payment policy, without prior notice, while respecting orders already placed.

 

4.17. PROHIBITIONS

4.17.1. It is strictly forbidden to transmit or post the unique serial numbers of tickets and/or passes on social networks or other similar websites (e.g. Facebook, OLX, etc.).

4.17.2. Failure to comply with these provisions will result in the cancellation of the invitations/tickets or passes marketed and a ban on festival access for the persons involved in this activity.

4.17.3. IMPORTANT! It is strictly forbidden to sell or buy invitations, and it is not recommended to purchase tickets or passes other than through the authorized ticket-selling platforms called Contractual Partners.

THE ORGANIZER CANNOT GUARANTEE THE VALIDITY OF ANY TICKETS NOT PURCHASED THROUGH THESE CONTRACTUAL PARTNERS. IF ANY FRAUD IS DISCOVERED WITH RESPECT TO A TICKET, THE ORGANIZER EXPRESSLY RESERVES THE RIGHT TO CANCEL THAT TICKET AT ANY TIME (even if the holder of a fraudulent ticket has managed to complete the check-in or transfer process). THE ORGANIZER DRAWS ATTENTION TO THE FACT THAT A NUMBER OF FRAUDS HAVE BEEN DISCOVERED RESULTING FROM THE SALE OF TICKETS THROUGH UNAUTHORIZED CHANNELS, AND THE CONSUMER ASSUMES, IN THIS CASE, THE RISK OF PURCHASING A TICKET THAT WILL NOT ALLOW THEM ACCESS TO THE FESTIVAL.

The Organizer reserves the right to resort to legal means to sanction those found to be carrying out such activities, as well as to cancel the relevant invitations/tickets/passes.

4.17.4. Purchased tickets and/or passes may be used for commercial purposes, such as organizing promotional campaigns, offering tickets and/or passes as prizes for contests, etc., only with the prior written consent of the Organizer. Failure to comply with this obligation will result in the cancellation of tickets and/or passes used for commercial purposes and will require the persons responsible to repair the damage thus caused. Furthermore, organizing promotional campaigns using Festival tickets and/or passes without the Organizer’s prior written consent constitutes an infringement of intellectual property rights relating to the Kapital Brand.

 

4.18. CONTRACTUAL PARTNERS

4.18.1. Tickets may be sold directly to Participants by Kapital or by its Contractual Partners, and payment for them is processed by Kapital’s payment processor or that of the Contractual Partners. The Ticket authorizing participation in the relevant Festival is sold to the Buyer on the Site or by other Contractual Partners. The Organizer only guarantees the validity of Tickets sold by itself or through the networks of these Contractual Partners.

4.18.2. Additional information regarding the detailed conditions applicable to purchasing Tickets online or in physical format will be provided by our Contractual Partners at the time of purchase of the item.

4.18.3. Our Contractual Partners sell Tickets at fixed locations and through online ticket purchasing interfaces.

4.18.4. The Buyer/Consumer will receive information from the Contractual Partners, in particular regarding the following aspects: fees and commissions applied to the price set by Kapital, payment and payment methods, invoicing, processing of the Buyer’s/Consumer’s data, and refund options, to the extent these exist.

4.18.5. Tickets accepted by the Organizer may be in physical or electronic format (eTickets), sent to you as a QR code in My Wallet in your personal account, in an email, or printed on paper, which each Participant must bring with them to the event or present in its original electronic format (on a phone, tablet, or other electronic devices that allow this). Attention! Photos taken of tickets are not accepted! Most customers of Contractual Partners receive tickets within 3-5 minutes after payment is successfully completed. If your ticket has not arrived by email within 24 hours of placing the order, you are obligated to contact the platform from which you purchased the ticket within a maximum of 10 days from purchasing the ticket, but no later than one day before the start of the Festival. Kapital bears no responsibility whatsoever for such situations, and in the absence of a valid ticket, access to the Festival cannot be permitted.

 

4.19. OTHER FEES AND SERVICES RELATED TO TICKETS

4.19.1. The final price paid by the Buyer is made up of: (i) the base price, representing access to the Festival, a fixed component for all ticket categories; (ii) system fees (administration and processing fees); (iii) VAT, applied in accordance with applicable law; and (iv) the value of the premium services selected, as applicable. The final price includes, as applicable, the Red Cross stamp duty and the fees payable to collective management organizations. The total value of the ticket, including all applicable fees and commissions, is displayed to the Buyer before the order is finalized.

4.19.2. Kapital assumes no responsibility for administration and processing fees, which may differ depending on the platform from which the ticket is purchased and the Contractual Partners from which the consumer/buyer purchases the item. Kapital is not liable for extra services offered by Contractual Partners.

4.19.3. Participants who purchase festival tickets may request the issuance of a tax invoice within no more than 5 calendar days from the end of the event. Requests submitted after this deadline cannot be processed. The invoice will be issued according to the data provided at the time of the request, and the organizers assume no responsibility for incorrect or incomplete information provided by the buyer.

 

4.20. RISK FREE

4.20.1. The additional Risk Free Service offered by Kapital, under which Kapital undertakes to refund the value of the access ticket to the buyer if the Buyer cumulatively meets the following conditions:

  1. requests the refund within the period set out in Article 4.20.2,
  2. fails to attend the event, and
  3. provided the buyer has opted for this service and paid the applicable fees, as follows:

4.20.2. The Buyer may request the refund of the purchased Risk Free ticket price at any time, but no later than 14 days before the start of the event.

4.20.3 Kapital undertakes to refund EXCLUSIVELY the ticket price, excluding the Risk Free fee (set by the organizer within the range of 10-25 Euro), within a maximum of 30 days from the date of the request, provided the Buyer has not changed their mind and has not used that ticket to access the festival, and provided the request was made within the deadline.

4.20.4. Except for the situations set out in Article 4.20, money for Tickets purchased for this event is non-refundable, as the purchase of tickets to shows and entertainment activities is exempt from the right of withdrawal governed by Government Emergency Ordinance 34/2014.

4.20.5. The Organizer assumes no responsibility for the loss or theft of the Ticket and/or pass. The Organizer has no obligation to refund the sum of money or replace the Ticket and/or pass in case of loss or theft of the Ticket and/or pass.

4.20.6. The Buyer expressly consents to the Organizer requesting and processing the Buyer’s home or residence address for the purpose of sending the festival access wristband directly to the address provided, in order to ensure a more pleasant and efficient means of accessing the Festival. The Organizer reserves the right to offer this option to Buyers for a fee, as an alternative to picking up the wristband from the location announced by the Organizer on the eve of or during the Festival. If this service becomes available, the Organizer will complete this section.

 

4.21. CHECK-IN OBLIGATION

4.21.1. To be granted access to the Festival Area, the holder of a valid access Ticket is required to check in the purchased Ticket. The buyer of a ticket may check in in one of two ways: online or on-site (at the venue).

4.21.2. Check-in may be done for a fee on-site (at the entrance to the Festival Area) or free of charge under certain conditions set out in these GTC, exclusively online (on the Site or through the application).

4.21.3 On-site Check-in (at the event venue)

4.21.3.1. On-site check-in will be carried out by the organizer’s Contractual Partners, using their own infrastructure and staff. Attention: On-site check-in will be available every festival day during the time interval announced by the Organizer.

4.21.3.2. On-site check-in is, in all cases, subject to a fee, payable at the ticketing points where the wristband will be issued based on the ticket. The fee for the on-site check-in service is 25 EUR and is paid at the time the buyer presents themselves with an original identity document.

4.21.3.3. Attention!!! Scanning of the identity document (identity card/passport) is only partial; only the following data is collected: first name, last name, gender, country/place of origin, date of birth, nationality, and the photo from the identity document, without retaining the following data, such as: the personal identification number, the ID series and number, photos of minors, or any other sensitive personal data. For further details on the personal data processed by Kapital, please read our Privacy Policy.

4.21.3.4. If the Ticket holder does not wish to have their identity document scanned, an operator will record the data provided by the person in question based on the original identity document presented on site.

4.21.3.5. Each holder of a valid Ticket who has checked in and presented themselves at the entrance to the Festival Area receives a Wristband (whose color depends on the type of Ticket purchased), to which the data collected during check-in is attached. Once the Ticket has been exchanged for a Wristband, the Wristband grants the rights and obligations provided for by the Ticket.

4.21.3.6. Kapital will register the Visitor’s Wristband during the entry procedure, provided the Visitor has validly checked in the Ticket.

4.21.3.7. Wristbands are non-transferable.

4.21.3.8. Visitors are required to wear Wristbands, for the duration of their validity, on the wrist or, in exceptional and well-justified cases, in another visible place, provided the Wristband cannot be removed without being damaged. Festival Organizers may inspect Wristbands at entry, at exit, and throughout the Festival area, for the entire Festival Duration.

4.21.3.9. The Visitor is fully liable for any damage to or loss of the Wristband.

4.21.3.10. Wristbands that are damaged, that have been resealed or cut, whose closing mechanism has been opened, that have a diameter larger than the wearer’s wrist, or that have been tampered with in any way, are NOT valid, and the organizers reserve the right to retain such wristbands, to refuse access to persons at the festival, and to report the situation to the competent authorities.

4.21.3.11. Kapital will only replace damaged or lost wristbands to the extent the Participant can prove they lawfully purchased the ticket associated with that wristband. Participants who cannot provide this proof lose the right to remain in the Festival Area and will be excluded from it.

4.21.3.12. In the event of loss or damage of any kind to the Wristband, the Participant is required to purchase a new Ticket for that day if they wish to remain within the Festival area.

4.21.3.13. If the wristband appears to have been fraudulently damaged, the Organizer has the right, in addition to the rights set out in Article 4.21.3.10, to require the Participant to purchase a one-day Ticket regardless of whether the Participant can prove they lawfully purchased a ticket and regardless of whether they still wish to remain in the Festival Area. This right may be exercised at the Organizer’s discretion, and depending on ticket availability for that day.

4.21.3.14. If, upon accessing the Festival Area, the Ticket holder is suspected of having unlawfully obtained the Ticket, Kapital expressly reserves the right to request the ticket holder to present evidence (documents and/or certificates) verifying the lawful acquisition or purchase of the Ticket, as well as the right to assess whether these are valid and compliant, and, in the absence of a purchase price refund document, to refuse entry of that person into the Festival Area.

4.21.4 Online Check-in

4.21.4.1. The Online Check-in process involves registering/assigning a valid ticket to an account created by the Visitor, via the Kapital site or application, and providing the personal data requested for this purpose. The online check-in process is free of charge only for the first 30 days after purchasing the ticket, after which a fee of 15 EURO is charged. Kapital encourages all Buyers to complete their online check-in at the time of purchasing the ticket in order to avoid paying additional fees and to help ensure smoother access to the festival. Payment of the online check-in fee will be made through secure payment platforms.

4.21.4.2. The 30 days of free Online Check-in are calculated starting from the day the pass was purchased.

For example: if the customer purchased a pass on 31.10, they may complete their Free Online Check-in until 29.11 (inclusive).

Online Check-in for tickets purchased offline — Partners

4.21.4.3. The process for claiming a ticket purchased offline is done by logging into the personal profile and entering the electronic code in the Redeem section. After the code is activated, the holder will receive the ticket in the My Wallet section and by email.

4.21.4.4. Check-in is free of charge during the first 30 days after purchasing the ticket. After this period, the user must pay a fee of 15 Euro for each Check-in performed. The platform will automatically indicate how many days remain in the free period and the amount of the Check-in fee.

4.21.4.5. If, after claiming the ticket, the holder is no longer able to attend the festival, they have the option to transfer the ticket to another person, subject to the provisions on Transfer and Online Check-in set out in this document.

Online Check-in for tickets purchased online

4.21.4.6. To complete online check-in, the ticket holder must log into the account with which the purchase was made and access the My Wallet section, where purchased tickets will be displayed. The holder must select the ticket for which they wish to complete Online Check-in and follow the indicated steps.

4.21.4.7. The user may complete check-in free of charge during the first 30 days after purchasing the ticket.

4.21.4.8 If the User is no longer within the free period (the first 30 days after purchasing the ticket), completing Check-in will require payment of 15 Euro. If a user has purchased several tickets, they will be required to pay the 15 Euro fee for each individual ticket.

4.21.4.9. After selecting the ticket, the user must upload a photo (ID-style) and complete the following data: first name, last name, phone number, email, gender, date of birth, country, city, county. In the case of minors, since their photo is not processed, the Organizer will automatically set a generic, impersonal image.

4.21.4.10. Users who have not yet turned 18 are required to download and complete the Declaration of Commitment form.

4.21.4.11. When completing Online Check-in, the Visitor is solely responsible for the accuracy of the data entered. The Organizer has the right to verify on site whether the data entered by the visitor matches the data on their identity card.

4.21.4.12. At the latest at the time of completing Online Check-in, the User acknowledges and agrees to the Festival’s Terms and Conditions, as displayed on the Site.

4.21.4.13. If the user has purchased several tickets and wishes to check in the other tickets as well, they may do so by entering, for each ticket, the data of the persons who will use the tickets. The holder of the group of tickets is directly and solely responsible for the accuracy of the data entered and must obtain the consent of each person for whom they perform check-in, confirming that they have read, understood, and agree to the GTC and the Privacy Policy.

 

4.22. TICKET TRANSFER POLICY

4.22.1. Transferring a ticket means the current holder passing the product to another person, who will assume the rights and obligations arising from its use.

4.22.2. Once the holder chooses to transfer the ticket to another person, they accept and acknowledge that they waive all rights they had over the ticket.

4.22.3. Check-in is free of charge during the first 30 days after purchasing the ticket. After this period, the user must pay a fee of 15 Euro for each Check-in performed.

4.22.4. Ticket transfer is subject to a fee. Transfer costs are as follows:

  • Standard General Access – 75 lei
  • General Access One-day Ticket – 35 lei
  • VIP – 150 lei
  • VIP One-day Ticket – 75 lei
  • Standard General Access Invitation – 150 lei
  • Standard General Access One-day Invitation – 70 lei
  • VIP Invitation – 250 lei
  • VIP One-day Invitation – 150 lei

4.22.5. Transfer is possible both for tickets with and without completed Online Check-in.

A. Transfer for tickets without completed online Check-in:

To complete the transfer, the ticket holder must log into their account and select the Transfer button, after which they will be automatically directed to the form for entering the information of the person to whom the transfer is being made.

B. Transfer for tickets with completed online Check-in:

To complete the transfer, the ticket holder must log into their account and delete the Check-in free of charge. After deletion, the holder will select the Transfer button and be directed to the form for entering the information of the person to whom the transfer is being made.

4.22.6. In both situations, after the transfer is completed by the former holder, the new holder must complete all steps for online check-in of the transferred ticket, free of charge or for a fee, depending on the number of days elapsed since the ticket was purchased. If the 30-day period from purchase has elapsed, the new holder receiving the ticket will pay the 15 Euro fee.

4.22.7. If the ticket holder has deleted their Check-in but no longer wishes to transfer the ticket, the provisions relating to completing a new Check-in remain applicable.

4.22.8. To complete a Ticket Transfer, the holder must fill in the details of the person who will receive the ticket (first name, last name, phone).

4.22.9 A ticket for which both Online Check-in and Online Top Up have been completed cannot be edited or transferred!

4.22.10. The only ticket transfer mechanism from one holder to another authorized and recognized by the Organizer is this one, through the official platform. Photos of QR codes are not accepted!

4.22.11. Access to the event will be granted based on an identity document (identity card or passport) and a ticket with a valid QR code.

4.22.12. For information and support, the user may send an email to ask@kapitalfestival.com.

 

5. RHUNA AND USE OF THE ACCOUNT BALANCE

5.1. General aspects

5.1.1. Rhuna, as defined in these Terms and Conditions, is used to purchase Rhuna products and services within the Kapital festival and on the Site.

5.1.2. Through the personal account on the Kapital platform (website or application), the user can top up an amount of money into the system by pressing the “Top Up Account” button, which, with their consent, will be converted into RHUNA and will be visible in the Account Balance section.

 

5.2. Use of Rhuna

5.2.1. Once the amount of money has been deposited into the Account Balance and converted into RHUNA, the user may use this instrument for:

  1. Purchasing Rhuna products and services.
  2. Loading it onto the ticket and the access wristband for the purchase of products and services within the festival.

 

5.3. Validity and withdrawal of Rhuna

5.3.1. RHUNA loaded into the Account Balance is valid until 31 December of each year corresponding to the festival edition. After this date, the amounts remaining in the Account Balance will expire.

Example: Money converted into RHUNA for the Kapital 2025 Festival remains valid for the purchase of products and services until 31 December 2025. Money added to the personal account in 2026 will be valid for the purchase of products or services until 31 December 2026.

5.3.2. Once amounts of money have been converted into Rhuna, the user can no longer convert Rhuna into its cash equivalent and/or withdraw the converted amount, except in exceptional circumstances (death, inability to use the account for an extended period of time, demonstrated through supporting documents).

 

5.4. Rewards System

5.4.1. The Organizer may grant certain benefits in the form of advantages and rewards that can be used to purchase Rhuna products and services within the festival, on the Kapital platform, or to carry out an online top-up on the ticket.

5.4.2. These benefits, called Rewards, have the following characteristics:

  • They cannot be withdrawn. Rewards cannot be converted into cash and withdrawn from the account.
  • They cannot be converted into their cash equivalent.
  • They expire at the end of the festival edition for which they were granted. Example: If the user received a reward for the Kapital Festival in March 2025, it may be used until the last day of the Kapital Festival 2025.
  • The cash equivalent of the Reward will be deducted with priority when purchasing Rhuna products and services or top-up. Example: If the user received a reward for the 2025 edition of the Kapital Festival and additionally loaded an amount of money into the Account Balance, when purchasing a product, the value of the Reward will be used first, then the loaded amount of money.

 

5.5. Payment processing

5.5.1. The Kapital platform uses Banca Transilvania services for loading amounts of money into the Account Balance, which are converted into Rhuna.

5.5.2. Online payment with your personal or company card can be made in complete safety. Cards accepted for payment are those issued under the VISA (Classic and Electron) and MASTERCARD (including Maestro, if they have a CVV2/CVC2 code) brands.

5.5.3. Payment relies on a secure online transaction processing system that provides confidentiality, security, and simplicity when purchasing products and services over the Internet. Card data processing is carried out exclusively through the bank.

5.5.4. The Organizer is not responsible for any technical or system errors that may affect the functioning of the Account.

5.5.5. The user is responsible for the security of the access data to their personal account and for all activities carried out in their account. The Organizer is not responsible for unauthorized use of the user’s personal account.

 

6. TOP UP ONLINE

6.1. Top Up Online is a service offered by the Festival to users, allowing them to load their festival ticket with money via online payment or transfer from My Balance, with that amount then being transferred to the festival wristband. This service is available only to users who have completed valid online check-in.

6.2. Top Up Online can only be carried out from cards that have 3D Secure activated.

 

6.3. Pre-festival Top Up Online – for users who have completed Online Check-in

  1. After completing online check-in, the ticket becomes available in the Account Balance area and Top Up can be carried out by activating the “Top Up Details” button.
  2. The user can select different top-up options:
  • One-time Transfer from the user’s account: The selected amount to be loaded onto the wristband is transferred once.
  • Auto top-up when the balance falls below a certain value: By activating this option, when the credit falls below a certain amount set by the user, the account’s ticket is automatically topped up with the set amount, drawing funds from the Account Balance or from the card, if the Account does not have sufficient funds.
  1. The user will be redirected to a secure payment page, where they will need to enter their card details and the 3D Secure verification code.
  2. After successful payment, the user will be able to view the total amount deposited on the ticket.
  3. After completing the online Top Up, the amount of money on the wristband will need to be activated at any of the merchants within the Festival or at Credit Points.
  4. After activating the top-up, the User can spend the money at the Festival, at any time, throughout the entire festival period.
  5. If the user has spent all their money, they can repeat the same steps described above to reload their wristband, or they can go to any top-up point – Credit Point within the festival.

 

7. PAYMENT METHOD WITHIN THE FESTIVAL

7.1. The payment method for Products and Services offered within the Festival Area is through multi-use vouchers used via payment devices (RFID) made available by Kapital, through the Festipay service, i.e., their activation on the wristband.

7.2. Participants are required to use only the payment methods and instruments established by the Organizer within the Festival Area.

7.3. Upon entering the Festival Area, each Participant will receive, for the purpose of access, a Wristband (with an integrated payment system) with which they can purchase the Products and Services available at the Festival. Cash payment within the Festival Area is strictly prohibited, outside the Credit Point areas previously established by the Organizer.

7.4. These payment instruments are considered MPVs (multi-purpose vouchers), as defined by the European Commission, due to the fact that, in exchange for the Credit Points on the payment instrument, the Participant may purchase services/products subject to different VAT rates. In this case, VAT is collected upon use of the credit points. At the same time, issuing a fiscal receipt and/or an invoice for the purchased Product/Service is the responsibility of the merchants (Contractual Partners). If a Participant wants a tax invoice for Products/Services purchased at the Festival, they are required to keep all fiscal receipts from each merchant (Contractual Partner) in order to subsequently request the tax invoice from those Contractual Partners.

7.5. The Organizer may provide Visitors with proof that the transaction (deposit or withdrawal of funds) was carried out.

7.6 The procedure regarding transactions in the electronic system during the Festival is as follows:

  1. Upon entering the Festival Area, after obtaining the Wristband, it is recommended that each Participant go to a “Credit Point” to load their Wristband with credit points.
  2. The Wristband will be the only means of payment within the Festival.
  3. The conversion rate for this MPV (multi-purpose voucher) is: 1 leu = 1 credit point.
  4. For each top-up, the Organizer may, but is not obligated to, hand the Participant proof of the amount deposited on the Wristband.
  5. Damaged Wristbands may be deactivated and replaced with other Wristbands at the Help Desk – Credit Point, located in the Festival Area, throughout the Festival Duration, taking into account the provisions of point 4.21.3.11.
  6. After obtaining a new Wristband from the Help Desk – Credit Point, the amount held by the Participant on the damaged Wristband will be transferred to the new Wristband.
  7. Participants may load their Wristband as many times as they wish, but each top-up must be for a minimum amount of 1 leu.
  8. The Participant has the right and the ability to check the amount available on the Wristband at any Contractual Partner within the Festival Area or at a Credit Point.
  9. Loading/reloading the Wristband can be done either by cash, by bank card, or through the Site (for bank cards issued under the Visa, Visa Electron, Mastercard, Maestro brands, issued by any bank in the world), in accordance with the “Top Up Online” chapter of these Terms.
  10. In the case of Wristband loading/reloading through the Site, the Participant assumes full responsibility for the card details entered on the platform.
  11. For the first payment made by bank card, the 3D Secure code will be requested. If the first payment is authorized, subsequent payments may be made without the 3D Secure code.

7.7. No commission is charged for payments by bank card!

7.8. Purchase of Products/Services from merchants (Contractual Partners):

  1. The Participant chooses the desired Product, at which point the relevant Contractual Partner enters the amount into the POS terminal;
  2. Each Participant is required to check the amount entered by the Contractual Partner into the POS terminal, and after verification, tap the chip on the Wristband against the POS terminal (card reader) – contactless – to complete the payment;
  3. Contractual Partners are required to issue fiscal receipts to Participant customers (and invoices, upon Participants’ request).

 

8. REFUND – Return of money remaining on the Wristband, at the end of the Festival

8.1. REFUND is the action by which a festival-goer recovers the money remaining on their wristband, under the conditions detailed in these Terms.

8.2. Unused amounts on the RFID wristband may be exchanged for cash through the process called REFUND, if all conditions imposed by the Festival are met.

8.3. If the festival-goer has not withdrawn the unspent amounts from the wristband, or has not taken action to request redirection to the Account Balance, a return to card, or donation of the amount by the announced date, these amounts become the property of the Festival.

 

8.4 Refunds can be carried out through the following methods:

8.4.1. ON-SITE REFUND

8.4.1.1. Returning amounts at any of the top-up points within the Festival area, at any time during the festival period, but no later than the date and time communicated by the Organizer, from the Ticketing point outside the Festival area.

Any request received after the announced date will not be taken into account by the organizer. In this situation, the organizer cannot be held responsible for failure to refund the amount, it being the festival-goer’s sole responsibility to comply with the established deadline. WE RECOMMEND THAT FESTIVAL-GOERS MAKE THEIR REFUND REQUEST AT THE LATEST WHEN THEY LEAVE THE FESTIVAL ON THEIR LAST DAY OF ATTENDANCE.

8.4.1.2. The returned amount represents the entire remaining balance on the RFID Wristband account (including amounts resulting from online transactions).

8.4.1.3. To carry out the Refund, the festival-goer must wear the wristband and ensure it shows no signs of tampering (except in cases agreed by the Festival and set out in these Terms).

8.4.1.4. If the customer carried out the Top Up using a bank card, the maximum amount they can withdraw in cash may not exceed 2,000 LEI.

8.4.1.5. For situations where the wristband balance exceeds 2,000 LEI, the customer must present at the HelpDesk the receipt issued by the bank’s POS terminal, as proof of the deposit. The customer will complete a refund request for this amount, which will be sent to the banking partner. Refund processing may take up to 14 business days. Amounts requested by completing the form will be returned to the account from which the payment was originally made.

8.4.1.6. Holders of cardboard tickets may only request a refund at the on-site points.

8.4.1.7. The festival-goer also has the option to donate amounts remaining on the wristband to a cause supported by the Organizer, under the conditions set out above at point 8.4.1.1.

8.4.2. ONLINE REFUND

8.4.2.1. The Online refund process is carried out through the user’s account, in the Account Balance section. The festival-goer will press the “Refund” button and will have the option on the platform to select one of the following actions regarding the amounts on the ticket:

  1. Redirecting the amount back to the Account Balance. Amounts in the Account Balance can be used to top up a ticket for a new event or to purchase products and services.
  2. Donating the amount to a cause supported by the Organizer.
  3. Returning the amount to the card with which the top-up was made.

8.4.2.2. The online refund process concerns only the return of amounts originating from ONLINE transactions. The refund will be carried out by expressing an option, starting with the period and time interval communicated by the Organizer, as also indicated on the platform. Any request received after this date will not be taken into account.

8.4.2.3. In this situation, the organizer cannot be held responsible for failure to refund the amount, it being the festival-goer’s sole responsibility to submit the refund request within the allotted time.

8.4.2.4. A commission of 5 RON – a processing fee – is charged for the online return of unused amounts, automatically withdrawn from the festival account. Redirecting amounts back to the Account Balance carries no fees.

8.4.2.5. If a user has carried out a pre-festival Top Up and wishes to request a refund before the start of the Festival, they may only do so in exceptional situations, assessed individually by the Organizer.

8.4.2.6. The festival-goer is permanently shown, within their account, the total amount of money they still have on the wristband and that they can request via online REFUND.

8.4.2.7. The festival-goer also has the option to donate the amounts remaining on the wristband to a cause supported by the Organizer, under the conditions set out above at point 8.4.2.2, by selecting the “Donate” button within the ONLINE CHECK-IN & TOP-UP account.

 

8.5. Order of REFUND where top-up was carried out using multiple bank cards.

Each transaction is associated with a bank card. If two top-up transactions are made from two different cards, the money will first be debited from the first card used for the top-up. For example, if 100 RON is first loaded from one card and then 100 RON from a different card, and 80 RON is spent at the festival, the remaining balance on the wristband account will be 120 RON. At REFUND, 20 RON will be returned for the first transaction (the first card from which the online top-up was made) and 100 RON to the second card, for the second online transaction.

 

8.6. REFUND where the festival-goer has carried out both an online top-up and an on-site top-up:

If there are unspent funds on the wristband, an online refund is only possible up to the available online balance, visible in the application, i.e., from the funds remaining from the amount loaded via online top-up. The remainder of the amounts from on-site top-up can only be withdrawn at the top-up points within the festival, no later than the date announced by the Organizer.

 

9. GENERAL FESTIVAL ACCESS RULES

9.1. Entry to the Festival is possible only through the designated locations and at the established times, exclusively for Authorized Participants.

9.2. Access to the Festival Area is only through specially arranged entrances, in compliance with the procedures for registering purchased Tickets, and the check-in and access rules set out in these GTC.

9.3. To reduce congestion in the access area, as well as discomfort for participants, two entries per day into the festival will be allowed.

9.4. Access to the Festival Area will depend on the type of ticket purchased.

9.5. In addition to the Ticket, Participants are required to carry identity documents with them.

9.6. At the request of the security team or the Organizer’s representatives or other competent bodies or authorities, the Participant is required to present access documents and identity documents.

9.7. These GTC will be displayed in a visible place at the festival entrance and in other public areas within the festival.

9.8. To ensure the Festival runs safely, Kapital reserves the right to restrict the type of items that may be brought into the Festival area.

This list is not exhaustive; the organizer has the right to deny festival access to the extent that an item held by a participant could endanger the safety of other participants or pose a danger to the safe running of the event.

Therefore, it is forbidden to enter the Festival with the following items:

  • Drugs, substances whose use is prohibited, or any type of psychoactive substances;
  • Accessories for using the substances described above;
  • Bottles (including but not limited to PERFUMES, sprays, or deodorants);
  • Flammable cosmetic products (beach cream is allowed);
  • Backpacks or bags larger than 29 cm x 21 cm x 12 cm;
  • Beverage cans;
  • Tin cans;
  • Fireworks;
  • Lasers;
  • Sprays or corrosive/flammable substances, paints, or containers with harmful or flammable substances;
  • Banners held up by sticks;
  • Chairs;
  • Weapons or any objects that can be adapted as weapons or projectiles;
  • Knives, blunt objects, or any objects with a sharp point or sharp edge;
  • Chains or objects with attached chains (such as wallets, trousers, etc.);
  • Torches, smoke devices, or any other pyrotechnic items;
  • Food or beverages;
  • Animals;
  • Umbrellas of any kind or shape (in case of rain, ponchos will be used);
  • Flammable or explosive materials;
  • Professional photo or video cameras, including any type of DSLR camera or camera with detachable lenses;
  • Any type of object that could injure other Participants;
  • Drones;
  • Speakers, amplifiers, or audio systems;
  • Devices that produce sound, whether electronically, mechanically, or manually operated, such as megaphones or vuvuzelas, musical instruments;
  • Selfie sticks or tripods;
  • Lasers;
  • Any flammable substance;
  • Any offensive, racist, xenophobic materials that promote sexual, religious, political, or other discrimination, illegal/prohibited materials, or discriminatory propaganda messages;

The following items are permitted:

  • Compact cameras;
  • Lighters;
  • GoPro cameras;
  • Selfie sticks (small in size and made of lightweight materials);
  • Portable external battery packs;
  • Lipstick or lip balm;
  • Beach cream;
  • Non-flammable perfume or deodorant in containers smaller than 50ml;
  • Baby bottles.

Medication accompanied by a medical prescription, insulin, medical-use drops, and asthma inhalers are permitted only if accompanied by a medical letter or any other substitute document, and in the maximum recommended daily quantity.

9.9. As a result of the very strict rules regarding prohibited items, persons responsible for the security and monitoring of the Festival will thoroughly search each Participant, and any prohibited items found during the check will be confiscated at the gate, without the Organizer assuming any responsibility for them.

9.10. All Participants are advised to consult the list of prohibited items and not to carry such items with them at the Festival.

9.11. As regards lost items, the Organizer will arrange a special space where such items may be brought and from which each owner may recover their belongings within 72 hours, but no later than the first day after the Festival ends – at the time announced by the Organizer.

9.12. The Organizer may, but is not obligated to, photograph lost items and post them on social media, as applicable, to the extent this does not breach legal rules on personal data protection.

9.13. After the first day following the end of the Festival, at the time announced by the Organizer, all unclaimed items will be handed over to their issuers (for example: identity card, birth certificate, etc., to the attention of the Municipal Police; bank cards to the attention of the issuing banks). Items with no identifiable issuer, regardless of value, will be donated for charitable purposes, to the extent possible and depending on the nature of the items.

9.14. The Organizer is not responsible for Participants’ belongings or for any damage caused to them.

9.15. It is forbidden to enter the Festival Area with cars, rollerblades, skateboards, bicycles, hoverboards, and other similar items.

9.16. For the comfort of participants, the organizer reserves the right to temporarily halt access to certain areas if it considers that these areas have reached their authorized maximum capacity.

 

10. MINORS AND PERSONS WITH DISABILITIES

10.1. Minors are strictly forbidden from consuming alcoholic beverages, tobacco products, electronic cigarettes, prohibited substances, or any other products whose use is restricted by law to persons under 18.

10.2. For the purpose of proper identification and monitoring, minors will receive, upon access, a distinctive wristband, different from the one given to adult participants.

10.3. At the request of security staff, monitoring teams, or the Organizer’s representatives, the minor and/or their companion are required to present a document proving the minor’s age (identity card, passport, student ID with photo, or any other official document containing the minor’s photo and date of birth).

 

10.4. Access of minors based on age

10.4.1. Minors under 7 years of age

  1. Access to the Festival for minors under 7 years of age is free of charge.
  2. Access is permitted only in the company of a parent or legal guardian.
  3. The Organizer recommends that minors under 7 be present in the Festival Area no later than 19:00.

10.4.2. Minors between 7 and 14 years of age

  1. Access for minors between 7 and 14 years of age is permitted only with a valid Ticket and a Declaration of Commitment completed and signed in accordance with these Terms.
  2. Access is permitted only in the company of a parent or legal guardian.

10.4.3. A parent or legal guardian may accompany only one minor under the age of 14.

10.4.4. Minors between 14 and 16 years of age

  1. Access for minors aged 14-16 will only be granted based on a valid Ticket, a valid identity document, a Declaration of Commitment completed and signed in accordance with these Terms, and in the company of an accompanying adult.

10.4.5. Minors between 16 and 18 years of age

  1. Access for minors aged 16-18 will only be granted based on a valid Ticket, a valid identity document, and a Declaration of Commitment completed and signed in accordance with these Terms.

 

10.5. Declaration of Commitment

10.5.1. For access of minors between 7 and 18 years of age, a parent or legal guardian must complete and sign the “Declaration of Commitment,” available on the Organizer’s website, kapitalfestival.com. The Declaration of Commitment must be handed over at the time the access wristband is collected. In the absence of this declaration, the access wristband will not be issued, and access of the minor to the Festival Area will be refused, regardless of whether they are accompanied or not.

10.5.2. The person who completes and signs the Declaration of Commitment is required to provide valid contact details, at which they can be reached in case of emergency throughout the Festival.

10.5.3. The Organizer reserves the right to request, at any time, additional documents to verify the identity and age of the minor and the status of the person accompanying them or assuming responsibility for them.

10.5.4. The Organizer assumes no responsibility regarding the verification of signatures or the manner in which the declarations are signed, these aspects remaining the responsibility of the persons presenting the declarations.

 

10.6. In certain areas of the Festival, access for minors under 18 is strictly prohibited (for example: the VIP area).

10.7. Due to the very loud noise produced at the Festival, the Organizer does not recommend the presence of children under 7 at the Festival.

10.8. Minors under 4 years of age must wear noise-cancelling headphones.

10.9. Exceptional situations in which discounts/free admission are granted to a certain category of minors or other Participants will be indicated on the site (e.g., e-Tickets) and sent to you as a PDF attachment in an email, which each Participant must print and bring to the event, or present the ticket in electronic format (on a phone, tablet, or other electronic devices that allow this) when checking in at the venue.

10.10. Most customers of Contractual Partners receive PDF tickets or a QR code approximately 3-5 minutes after payment is successfully completed. If your ticket has not arrived by email within 24 hours of placing the order, you are obligated to contact the platform from which you purchased the ticket and resolve this issue within a maximum of 5 days from purchasing the ticket, but no later than one day before the start of the Festival. Kapital bears no responsibility whatsoever for such situations, and in the absence of a ticket, access to the Festival cannot be permitted.

10.11. Persons with disabilities classified under a disability category, and their companions (if the need for a companion was established by an evaluation commission and can be proven by a document issued by a competent authority, or was noted in the disability registration certificate), benefit from the following facilities, within a limit of 150 passes for the festival days:

  1. Children with disabilities and their designated companions receive a pass free of charge;
  2. Adults with severe disabilities and their designated companions receive a pass free of charge;
  3. Adults with pronounced disabilities receive a pass free of charge;

10.12. To benefit from free admission, adults with disabilities (or, in the case of minors, their legal representatives) must send a request expressing their wish to attend the festival, together with a signed declaration on their own responsibility confirming their disability classification, to hello@kapitalfestival.com. In the case of a request for a companion’s pass, the Organizer may request additional documents proving that the companion was designated in accordance with the law. If persons with disabilities are granted a ticket or pass, they will receive an email from the Organizer to this effect. These persons are subsequently required to present, in original, at the access point mentioned in the confirmation email received, the disability certificate and identity card for verification.

10.13. Free access for persons with special needs is granted only based on an identity document, the disability certificate, and confirmation received by email from the Organizer.

10.14. Incomplete requests and/or requests sent to other email addresses will not be taken into account.

10.15. The Organizer reserves the right to deny festival access to persons with disabilities who do not present these documents in original, as well as where the Organizer’s representatives have justified doubts about the validity or authenticity of the documents presented.

10.16 !!! The registration period to benefit from free admission for the 2027 edition, provided for in Article 10.11, is 01.12.2026 – 01.03.2027, by sending an email to hello@kapitalfestival.com. All requests sent outside this period will not be taken into account.

10.17. Given that this facility can only be granted within a limited number of places, taking into account the Festival’s total capacity as well as safety and security standards, free admission will be granted in the order in which requests are received.

10.18. Once the number of 150 requests meeting the above conditions is reached, the Organizer will indicate in these GTC that the maximum number of tickets granted free of charge to persons with disabilities has been reached, and from that point the Organizer will no longer respond to requests submitted in this regard.

10.19. The Organizer will respond to these requests within 30 days from the date the requests are made.

10.20. Persons classified with a severe disability undertake to always come to the Festival accompanied, for personal safety reasons.

10.21. The Organizer recommends that all minors and persons with disabilities come to the Festival accompanied.

10.22. The Organizer will not be held responsible for any incident or accident involving minors or persons with disabilities. Full responsibility for them rests with the minors/persons with disabilities and/or their parents/legal representative or companion. The Organizer draws the attention of parents/legal representatives or persons exercising parental authority to the fact that they are responsible for supervising the minor and will be held liable for any damage resulting from failure to comply with this obligation.

10.23. For the attention of persons with mobility impairments who use a wheelchair: only certain areas of the Festival have entrances with wheelchair-accessible facilities, marked on the Festival map.

10.24 In accordance with clause 10.18, the Organizer announces that the maximum number of 150 tickets granted free of charge to persons with disabilities has been reached.

 

11. CONDUCT DURING THE FESTIVAL

11.1. Within the Festival Areas, visitors are required to refrain from any action, statement, or conduct likely to endanger the life, health, or physical integrity of other persons, or that could infringe their personal rights.

11.2. Any form of economic, commercial, or advertising activity is prohibited within the Festival Area — including in the area in front of the Festival gates — without Kapital’s prior written permission. If the Organizers find that such activities are being carried out within the festival area, they reserve the right to remove the persons involved and to ban them from festival access.

11.3. The sale of alcoholic beverages must comply with legal provisions, and no such beverages may be offered to minors under 18 or to persons who are intoxicated by any vendor at the Festival. The serving of beverages (soft or alcoholic) by the organizer’s Commercial Partners will be done exclusively in open containers (made of aluminum or plastic).

11.4. The use of substances classified as drugs is prohibited within the Festival Area and is punishable by law. The Organizer reserves the right to cut the wristband of any Participant who breaches this provision, to remove them from the Festival premises, and to permanently deny them access, while requesting the intervention of the competent authorities.

11.5. Kapital reserves the right to introduce a system at the Festival whereby alcohol may only be offered to Visitors if the Visitor in question presents certification or a document showing they have the right to consume alcohol (e.g., an identity card proving their age).

11.6. Any demonstration of any kind unrelated to the Festival organized by Kapital is prohibited, regardless of the number of participants, unless Kapital has given its prior written approval to this effect. Such approval is granted by Kapital at its sole discretion, based on the prior request of the organizer of the relevant demonstration. If an approval is obtained, participants are required to comply with these GTC and to behave in a manner that does not disturb, hinder, restrict, or make impossible the entertainment of other Visitors, the ability to move within the Festival area, access to the Festival area, or the ability to leave the Festival area, as well as the use of Services and/or Products by other Visitors/Merchants.

11.7. Kapital has the right to put an end to demonstrations (both those it has authorized in accordance with the above and those it has not expressly authorized), without providing a reason. Kapital has the right to set the conditions for demonstrations, in particular the number of participants, their location, and duration, at its sole discretion. If Kapital declares a particular demonstration ended, participants are required to stop the demonstration immediately. If Kapital sets conditions for an authorized or recognized demonstration as described above, participants are required to fully comply with these conditions.

11.8. Within the Festival Area, authorized and appropriately qualified employees of Kapital or its Contractual Partners, as well as employees or collaborators of the Partners, will ensure compliance with rules of conduct and safety. By participating in the relevant Festival, Visitors expressly undertake to fully cooperate with these persons within the limits of the law and to comply with their instructions within the Festival in the event of an emergency or if other significant circumstances (e.g., public health reasons) justify it.

11.9. At the Festival, both free Services and Products, as well as Services and Products subject to a fee, may be used. Visitors undertake to pay for all Services and Products subject to a fee, and assume responsibility for the immediate payment of all prices and purchase fees owed.

11.10. Visitors will pay for Products and Services subject to a fee using the payment methods offered by Kapital or the Contractual Partners. If Kapital so decides with regard to any area of the Festival, all prices and purchase fees will be payable exclusively through the methods designated by Kapital, instead of cash.

 

12. VIDEO SURVEILLANCE AND PROCESSING OF PERSONAL DATA

12.1. For security reasons, the Festival Area is monitored by video cameras operated by Kapital’s Contractual Partners. Processing of your personal data captured through the surveillance cameras takes place at any time you are on the festival premises, and by participating in the Festival, the Participant explicitly consents to this processing. In addition, concerts as well as the entire festival may be recorded on video/photo by our contractual partners, for marketing and advertising purposes, as mentioned in Chapter XIV.

12.2. The categories of personal data processed, the means and purposes of processing, as well as Kapital’s entire policy regarding the processing of personal data can be found in the Kapital Festival 2027 Privacy Policy, available in the Privacy Policy section.

12.3. In accordance with EU Regulation 679/2016 (GDPR), you benefit from the right of access, rectification, the right to obtain erasure of data or restriction of processing, the right to data portability, the right to object, and the right not to be subject to a decision based solely on automated processing.

12.5. If you consider that your personal data is being processed in breach of applicable law, please contact us at dpo@kapitalfestival.com, or you may contact the National Supervisory Authority for Personal Data Processing.

12.6. For more details regarding the processing of personal data, we encourage you to consult the Privacy Policy available on the Site.

 

13. HEALTH AND SAFETY

13.1. Given the scale of the Festival, the Organizer will take appropriate measures so that Participants are informed about the prevention and protection measures and activities within the Festival Area.

13.2. Each Participant is required to behave in a civilized manner towards other Festival Participants.

13.3. To the extent the Organizer considers that a Participant endangers the safety of other Participants, or creates a situation of discomfort for them, or behaves in a manner that affects the proper running of the Festival or the festival atmosphere, the Organizer reserves the right to cut that Participant’s wristband and to request the assistance of the Gendarmerie or the security company to escort that Participant out of the Festival and to permanently deny them access back into the Festival.

13.4. Government agencies, Ministry of Internal Affairs institutions, or other authorized bodies may provide the Organizer with a negative recommendation regarding the access of a ticket and/or pass holder to the Festival. In this case, the Organizer is entitled to refuse the Buyer entry to the event premises, and the latter will have no right to compensation.

 

14. RECORDINGS MADE DURING THE FESTIVAL

14.1. By purchasing a ticket and attending the Festival, the Product Buyer agrees to be photographed, filmed, or recorded by the Organizer, the venue management, or any third party operating on behalf of the Organizer within the Festival or in the immediate vicinity of the venue entrance. In addition, by purchasing a Product, the Product Buyer consents to photographs, video, or audio recordings of them at the Festival or in the immediate vicinity of the venue entrance (“Recorded Material”) made by the Organizer, the venue management, or any third party operating on behalf of the Organizer. You hereby agree that the Organizer, the venue management, or any third party operating on behalf of the Organizer may use the Recorded Material in any manner it deems appropriate, without restriction, approval, or compensation.

14.2. The Organizer holds the image rights over the entire Festival and may use the photo and video images taken both by its own staff and by participants, in various materials produced during the Festival.

14.3. Participants acknowledge that Kapital, its Contractual Partners authorized by Kapital, associates, members of the press, other visitors, and other third parties may produce audio recordings and images of the Festival. Accordingly, Participants, by purchasing a Product and by virtue of their participation in the Festival, grant the Organizer permission to record and publish their image, appearance, and actions in accordance with Article 16.1.

14.4. Kapital and persons authorized by Kapital have the unrestricted right to profit from, use (in particular for the purpose of promoting the Festival), copy, publish, publicly broadcast, and distribute such recordings of Visitors, without being required to pay Visitors for this.

14.5. Visitors expressly acknowledge that Kapital may record the Festival, concerts, and programs, may copy the recordings and distribute them via image-carrying media, may broadcast or otherwise make them public, and may do so repeatedly, including by informing the public about the Festival, concerts, and programs, via cable data transmission or any other means (e.g., via YouTube), so that members of the public may individually choose the place and time of access.

14.6. Visitors have no right, within the limits of legal provisions, to raise claims against Kapital in connection with the recordings and their publication as set out above.

14.7. Without Kapital’s prior consent, Visitors may not sell, use for a price, or use free of charge for commercial purposes, the image and voice recordings they have made, identify Visitors appearing in such recordings without their consent, or infringe the personal rights of other Visitors.

14.8 The Organizer reserves the right to establish areas/locations where photography/filming is prohibited. In case of non-compliance, the Organizer has the right to delete such recordings.

 

15. LIMITATION OF LIABILITY AND FORCE MAJEURE

15.1. Kapital provides no guarantee regarding the possibility of entering the Festival at the desired time or the possibility of attending a concert at the previously announced time, and explicitly excludes any refund of the Product price, the granting of an additional discount, or the payment of any damages or compensation as a result of these facts.

15.2 Kapital recommends that all participants complete their online check-in at the time of purchasing the ticket and arrive at the Festival at least a few hours before the concert they wish to attend.

15.3. Kapital reserves the right to modify, restructure, and further develop the Festival, the Services and Products offered at the Festival, including but not limited to changes to the program (artistic, organizational, etc.), and to change the location where the Festival takes place, at its own discretion. Participants have no right to any claim against Kapital regarding these changes, restructurings, or subsequent developments. Nevertheless, Kapital will make every effort to provide the announced programs and Services, and, if providing them becomes impossible, to replace the cancelled program or previously announced Service with another program or Service.

15.4. Accordingly, Kapital will not guarantee to the Visitor the availability, content, quality, and quantity of programs and Services (such as the performance or appearance on stage of a particular artist, the fact that a particular artist’s performance will meet the Visitor’s expectations, or the opportunity to attend a particular artistic program and/or a particular location). These elements may take shape depending on the special characteristics of the venue, extraordinary situations that arise, and the equipment present within them (such as the number of seats at a particular venue).

15.5. Kapital is not obligated to cancel the Festival in case of unfavorable weather; however, if the authorities require Kapital to suspend or close the Festival due to a fortuitous event or force majeure, the Festival or part of it will be cancelled/suspended, and Kapital cannot be held liable to festival-goers or other third parties for such closure/suspension.

15.6. Participants expressly acknowledge that they may also purchase Products and Services in connection with the Festival that are offered by other Contractual Partners and not by Kapital. In such cases, the contract is concluded directly between the Visitor and the Contractual Partner, and the rights and obligations arising from the legal relationship apply exclusively to the Visitor and the Contractual Partner.

15.7. Kapital assumes no responsibility for damages arising from or suffered in connection with the purchase or use of Services and Products provided by Contractual Partners, or for damages of any kind suffered by visitors as a result of attending artistic performances or subsidiary activities within the Festival.

15.8. Visitors will enter the Festival entirely at their own risk, being liable for damages suffered by them or caused to other participants within the Festival premises. Kapital will only be liable where such damages are caused exclusively by Kapital and could not have been avoided by the Participant through the exercise of due diligence.

15.9. Lost and found items may be handed in at the information desk indicated on the map. Visitors may inquire about lost items at the same desk.

15.10. Participants are fully liable, both under civil law and criminal law, for any damage they cause to Kapital, its Contractual Partners, and other Visitors and Third Parties at the Festival or in connection with the Festival.

15.11. Kapital is not responsible for damages that may occur outside the Festival Area or on the way to or from the Festival Area.

15.12. Kapital has the right to immediately terminate its legal relationship with a Participant (holding a Ticket or Wristband) who has breached any provision of these GTC in connection with the Festival. In such a case, Kapital may invalidate the Participant’s Ticket or remove their Wristband, and the Participant will be required to leave the Festival. Kapital also reserves the right to refuse the purchase of a new ticket by that festival-goer for the entire duration of the festival, or, if they obtain a ticket to the Festival, to refuse their entry to the Festival premises, without granting them any right to compensation.

15.13. In addition to the immediate termination of the legal relationship with the Participant, Kapital has the right to subsequently refuse their access to the Festival.

15.14. The Participant consents to receiving whatever medical treatment may be deemed appropriate in case of injury, accident, or illness during the Festival, and fully releases Kapital and all persons involved in providing such medical treatment from liability for any such actions.

15.15. First aid and medical assistance services will be provided continuously within the Festival Area. Kapital is not responsible for the manner in which these services are provided.

15.16. Various high-intensity light shows and pyrotechnic effects that may harm children or persons with epilepsy will take place during the Festival.

15.17. Participants suffering from mental or physical conditions who may be affected in any way by loud noises, special visual effects, crowded areas, special sound effects, or any similar phenomena assume full responsibility for any damage they may suffer.

15.18. Furthermore, the Organizer assumes no responsibility for any damage or injury that may arise as a result of fireworks. Participants assume full responsibility for their physical/mental capacity to take part in the various activities at the Festival.

IMPORTANT! We recommend undergoing specialist medical check-ups before participating in activities requiring a high level of physical effort.

15.19. Kapital will have no responsibility, of any kind, for any damage (direct or indirect) resulting from the use of, or inability to use, the information presented on the Site in connection with the Festival. Kapital may, without prior notice, delete, modify, or add any information on the Site, suspend any activity on the Site, and, where references are made to other websites, Kapital does not guarantee and/or confirm in any way the type of information that may be found on those websites.

15.20. Kapital is also not responsible for comments posted by users on the Site. Any information, data, text, photographs, graphics, etc. contained on the Site are the responsibility of the person/entity from which they originate. Under these conditions, Kapital cannot guarantee the content of the Site, including but not limited to, truncated, incomplete, or incorrect information, or for any consequences of their use.

15.21. Kapital provides no guarantee of any kind that the Site will function uninterrupted, securely, and free of any errors. The Site may be interrupted by the owner or administrators at any time, without prior notice and without any claim of any kind from its users.

15.22. The value of purchased tickets will not be refunded in the event the Festival is cancelled by the Organizer for reasons falling under force majeure or a fortuitous event. Force majeure or a fortuitous event means any external and unforeseeable event, including but not limited to: storms, threats or risk of terrorist attack, acts of public authorities, whether legitimate or not, epidemics, pandemics, accident, explosions, fires, floods, torrential rains, earthquake, social conflicts, major short circuit, high risk to public health, or any other cases that cannot be foreseen or averted through the Organizer’s diligence and prudence.

15.23. Relocating the event venue within the same geographic area does not constitute grounds for refunding the value of tickets.

15.24. The festival dates may be unilaterally changed by the Organizer in case of force majeure or a fortuitous event, without any obligation to refund the ticket price to the Buyer.

15.25. In the event of the death of the ticket holder, the event Organizer will refund the value of the ticket paid, provided the applicant presents supporting documents proving the event (for example, a death certificate).

 

16. INTELLECTUAL PROPERTY RIGHTS

16.1. Everything posted on the Site, as well as on various types of media within the Festival Area, such as, but not limited to, images, texts, graphic elements, symbols, logos, databases, etc., is the property of Kapital and/or its Contractual Partners. All of these are subject to intellectual property legislation.

16.2. Visitors and Third Parties may not use, copy, distribute, publish, or incorporate into other documents or materials such marks/information in any form for the purpose of generating revenue, without the prior written and express permission of Kapital and/or its Contractual Partners.

16.3. Images, logos, and texts of Kapital’s Contractual Partners belong to them and are reproduced on the Site or within the Festival Area with their consent.

16.4. Kapital will make every effort to identify messages received on the Site that were not addressed to it, by restoring the direct link to the source or by mentioning the persons appearing on this Site, but cannot always guarantee the existence of the reproduced source.

 

17. PROVISION OF INFORMATION / FRAUD ATTEMPTS

17.1. To use the Site, Site users agree to provide accurate information about themselves, as specified in the user registration section, and agree to provide this information correctly and completely.

17.2. Any attempt to provide false information, to access another user’s personal data, to alter the content of the Site, or to affect the performance of the server on which the Site is hosted, will be considered an attempt to defraud Kapital’s systems and will result in the immediate blocking of the Site user’s access. Kapital also reserves the right to report such an attempt to the competent authorities.

 

18. PROMOTIONAL OFFERS, RAFFLES, AND CONTESTS

18.1. Kapital will, at its discretion, establish the conditions for running promotions on the Site, in accordance with the law. Promotions, raffles, and contests run for a limited period and automatically expire on the date specified for each individual promotion, raffle, or contest.

18.2. Any promotion, raffle, or contest may be interrupted or cancelled at any time without prior notice. However, all participants will be notified of such interruption or cancellation.

 

19. DISPUTES

19.1. Any dispute arising between Kapital and its customers as a result of participation in the Festival or use of the Site will be resolved amicably. If this is not possible, disputes will fall under the jurisdiction of the Romanian courts in Cluj-Napoca or Bucharest.

19.2. The applicable law is Romanian law.

 

20. MISCELLANEOUS PROVISIONS

20.1. These Terms and Conditions, representing the Contract between the consumer and the Organizer, may be assigned by the latter without requiring the customer’s consent.

20.2. Chapter names and subtitles are for reference only and must not be taken into account in interpreting or construing these GTC.

20.3. If any clause of these GTC is declared void or unenforceable, the remaining clauses will continue to have effect, and the clause declared void or unenforceable will be replaced with a new clause that reflects the Organizer’s intent as closely as possible.

ANNEX 1

Terms and Conditions ONE FOR ALL PASS 2026

 

1. Definition

1.1.  The One for All Pass is a multi-event value voucher, purchased by the Buyer, which offers the possibility of attending, once, each of the following three events: UNTOLD 2026, KAPITAL 2026, and UNTOLD DUBAI 2026.

1.2.  The voucher does not constitute an access ticket at the time of purchase. It becomes a valid ticket only after registration (Redeem) by the Holder, in accordance with the conditions communicated by the Organizer.

 

2. Voucher registration

2.1. The Organizer reserves the right to send the voucher for each festival no later than 31 April 2026, absent exceptional circumstances that may lead the Organizer to postpone this moment.

2.2.  The Holder is required to register the voucher received in their personal account (the Redeem action) for it to become an actual ticket. Voucher registration is done exclusively through the personal account on the Organizer’s platform. Details regarding the Redeem operation can be found in the Terms and Conditions applicable to each festival.

2.3. After registration, the voucher becomes a valid ticket, issued electronically, which becomes subject to the General Terms and Conditions (hereinafter “GTC”) of the relevant edition.

2.4. Failure to register the voucher by the start date of the event is equivalent to voluntarily waiving participation in that event, with no possibility of modification, refund, or carry-over to future editions.

2.5. Failure to attend any of the events does not confer any right to subsequent refunds or transfers.

 

3. Particularities regarding Untold Dubai

3.1. The component relating to UNTOLD Dubai 2026 does not constitute a valid ticket until the following conditions precedent are cumulatively met:

  1. obtaining the Authorization to organize the 2026 event;
  2. issuance and distribution of tickets through entities licensed by the DTCM and in accordance with DET/DTCM rules;
  3. registration of the voucher by the buyer, in accordance with Article 2;

3.2. If the authorization referred to in point (a) is not obtained, only the component relating to the Dubai event will be refunded. Rescheduling the event does not entitle the holder to any other compensation, damages, or additional refunds.

3.3. The organizer of the event is Untold Dubai LLC, a company registered for tax purposes in the United Arab Emirates, and this component is subject to the tax regime and VAT rate of the UAE. The invoice for the Dubai component is issued only at the moment the voucher is converted into a valid ticket issued through the DET/DTCM system.

 

4. Online Check-in Obligation and FEES

4.1. By holding a One for All Pass, the holder acknowledges and undertakes, in accordance with the T&Cs of each event, to complete Online Check-in free of charge, within 30 days of the voucher being registered and converted into a ticket, for each event individually.

4.2. After this period expires, in order to complete Online Check-in, the holder will be required to pay the Online Check-in fee set by the event organizer, in accordance with the amounts and conditions communicated in the applicable T&Cs.

4.3. Check-in, editing, or transfer fees may differ from one event to another and are those published in the T&Cs of each festival.

4.4. The organizers of events in Romania are entities registered for tax purposes in Romania, part of the Untold Universe S.A. group, in accordance with Article 1 of the Terms and Conditions, and the prices and fees relating to these events include VAT in accordance with Romanian law.

 

5. General characteristics

5.1. Holding a One for All Pass product (G.A.) grants the buyer the same benefits as those associated with an actual General Access (G.A.) ticket, but with the particularities set out in this section.

5.2. The product purchased by the consumer is subject to the same transfer, edit, and top-up conditions described in the T&Cs applicable to the 2026 edition of each festival.

5.3. The right to attend each festival included in the product may be transferred only once, through the official platforms approved by the Organizer. Resale, assignment, or trading outside official channels may result in the immediate cancellation of the voucher, with no refund.

5.4. The Organizer will have the right to require the exclusive use of a specific payment method for payments made within the Festival, which may have a conversion rate different from the national currency. Festival-goers will be guaranteed the right to purchase this currency from a number of exchange points within the festival and/or directly through the app via the online top-up facility.

 

6. Reorganization of the event

6.1. The price of the product is non-refundable. In the event of the definitive cancellation of one of the included events, a proportional refund will be granted exclusively for the component relating to the cancelled event.

6.2. If the event is cancelled or rescheduled for reasons beyond the Organizer’s will or gross negligence, or that fall under force majeure or a fortuitous event, the holder will have the right to attend the rescheduled edition (of the same year), or, to the extent the event could not be rescheduled within the same year, the voucher’s validity period will automatically be extended by the period corresponding to a new edition.

6.3. Force majeure or a fortuitous event means any external event such as, but not limited to: storms, threats or risk of terrorist attack, decisions of public authorities, whether legitimate or not, epidemics, pandemics, accident, explosions, fires, war, floods, torrential rains, earthquake, social conflicts, major short circuit, high risk to public health, decisions by authorities, or any other cases that could not be foreseen at the time the following year’s edition was announced or averted through reasonable diligence and prudence by the Organizer.

6.4. The Organizer reserves the right to change the event venue within the same geographic area to the extent it considers this appropriate or necessary, and to notify buyers in such a case.

 

7. Obligation to comply with the Terms and Conditions

7.1. Holders of a One for All Pass voucher are required to comply with the T&Cs established by the Organizers for each festival. The general terms and conditions are available to any Buyer at any time for consultation, on the website www.untold.com, www.kapitalfestival.com, and www.untold.ae.

7.2. The Organizer reserves the right to amend or change the T&Cs and their Annexes, such amendments taking effect only after prior notice of these changes is published on the site.

 

8. Personal data protection

8.1. The Data Controller for the ONE FOR ALL Pass product is UNTOLD PRODUCTION SRL, a Romanian legal entity, part of the UNTOLD Universe group.

8.2. For the issuance of the ticket relating to the UNTOLD Dubai 2026 component, certain personal data will be transferred to NEVERSEA PRODUCTION SRL and UNTOLD Dubai LLC, an entity registered in the United Arab Emirates, exclusively for the purpose of issuing tickets and validating access to the event.

8.3. The international transfer of data from the EU to the UAE is based on Standard Contractual Clauses (SCCs), additional technical and organizational measures, and is carried out in accordance with the provisions of the GDPR and the PDPL.

8.4. For detailed information regarding the purposes of processing, categories of data, retention period, the rights of data subjects, and transfers, data subjects are requested to consult the UNTOLD Privacy Policy.

 

9. Applicable law and jurisdiction

9.1. Romanian law applies to the UNTOLD Europe and KAPITAL events.

9.2. United Arab Emirates legislation applies to the UNTOLD Dubai component.

9.3. Any dispute relating to the use of the voucher or the issuance of tickets will be resolved by the competent courts in Cluj-Napoca, Romania, for events in Romania, and by the courts of the Emirate of Dubai, for the Dubai component.
