KAPITAL GENERAL TERMS AND CONDITIONS  2026

EVENT: KAPITAL FESTIVAL

ORGANIZER: NEVERSEA PRODUCTION S.R.L

LOCATION: NATIONAL ARENA, BUCHAREST, ROMANIA

I. GENERAL PROVISIONS

1.1. The General Terms and Conditions (hereinafter GTC) apply to the organization and conduct of the KAPITAL event (hereinafter the Festival or Kapital), organized by the company NEVERSEA PRODUCTION S.R.L., with headquarters in Cluj-Napoca, Str. G-ral Eremia Grigorescu, nr. 122A, Cluj County, registered in the Trade Register with no. J2023005035127, VAT: 49168377 (hereinafter referred to as the Organizer or Kapital) and contain the provisions that each participant of the event undertakes to comply with. 

1.2. By purchasing a ticket or participating in the festival, the Participant declares that he/she has read, understood and undertakes to comply with the GTC which also include the Privacy Policy.

1.3. The General Terms and Conditions are valid for an indefinite period. The participants agree that Kapital has the right to unilaterally amend these GTCs without prior notice to them. If the GTC changes, those changes take effect immediately after publication on the Website. Kapital specifies that the GTC can be modified after the purchase of the Ticket, even immediately before the Festival. Kapital recommends the Participants to monitor any changes to these GTCs.

 

2. DEFINITIONS 

2.1. In the course of their use in this document, the defined time limits shall have the meaning agreed in this section, unless otherwise defined in this document:

a)      Add-on: Additional product or service options available exclusively to Festival ticket buyers, which allow them to benefit from special experiences during the event (e.g. backstage insider tour, backstage discovery tour, etc.). 

b) Ticket: a certificate issued in any form (on paper or in electronic form), one-day ticket, subscription or invitation certifying the right to a Festival Bracelet. The tickets are non-nominal or nominal and have a unique identification number. By purchasing the Tickets, the buyers undertake to comply with these General Terms and Conditions, the procedures for registering the purchased Tickets, the rules of check-in and access to the Festival, as well as any other rules of participation in it that are brought to their attention by various means, including directly through the Website. The purchase of Tickets/Bracelets from areas other than those authorized by the Festival Organizer is prohibited and leads to the restriction of access to the respective Festival.

b)      Bracelet: a certificate applied by Kapital to the validation of a Ticket, which offers rights identical to those included in the Ticket and – provided that it is secured according to section 3 below – exclusively certifies that its bearer has the right to visit the respective Festival; - a special payment instrument within the Festival.

c)      Ticket Buyer: the person who buys the Festival Ticket.

d)      Duration of the Festival: the duration of any Festival that will correspond to the period of time between the beginning and end of the Festival. The beginning of the Festival will correspond to the beginning of the validity of the tickets to that Festival that authorizes the first entry to the respective Festival. The end of a Festival will correspond to the end of the validity of the Ticket authorizing the longest stay at that Festival. Kapital reserves the right to organize programs or provide Services during the Festival.

e)      Festival: The Kapital Festival, consisting of all performing arts programs – music, entertainment and culture – and other free or paid Services offered by Kapital in a certain period of time and in a certain area determined by the Organizer.

f)       Organizers/Capital: Neversea Production S.R.L., headquartered in Cluj-Napoca, Str. G-ral Eremia Grigorescu, nr. 122A, jud. Cluj, registered in the Trade Register with no. J2023005035127, VAT: 49168377.

g)      Contractual Partner: an economic operator or other natural/legal person who carries out independent commercial activities at a certain Festival, based on a contractual relationship with Kapital.

h)      Participants: all the people who participate in the Festival.

i) My Wallet: The section of the personal account created on the www.kapitalfestival.com platform where the user can find the purchased tickets, the tickets available for check-in, the tickets for past events and the possibility to check-in online or top-up online on tickets.

j)      Product: the elements and rights of pecuniary value that may be purchased from Kapital or other Contractual Partners within or in connection with the Festival, as well as any vouchers or other similar means that may be offered in exchange for them.

k) RHUNA: a multi-purpose value coupon, which can be used for the purchase of "Rhuna products and services", i.e. those available in the ecosystem of events and festivals organized by the companies of the Untold group, which include the Massif Festival, the Untold Romania Festival and Untold Dubai, the Kapital Festival as well as the Neversea Festival. The purchase of RHUNA products and services is made from the platforms www.bemassif.comwww.untold.comwww.untold.aewww.neversea.com, www.kapitalfestival.com.

l) Rewards: benefits granted by the Organizer to customers to increase loyalty. These benefits and rewards can be used to purchase Rhuna products and services at festivals and on platforms associated with the Untold group.

m)       Service: any service made available by Kapital or its Contractual Partners within or in connection with the Festival, either free of charge or for a fee.

n) Sold Cont: the section of the personal account created on the platform www.kapitalfestival.com where the user can upload an amount of money. This amount is converted into Rhuna and can be used to purchase Rhuna products and services or to perform online top-up on the festival access bracelet.

o)     Site: the Kapital website, respectively www.kapitalfestival.com.

p)      TCG: These General Terms and Conditions governing the conduct of the Festival, available both on the Website (as defined above) and at all entrances to the Festival Area.

q)      Third parties: natural and legal persons, other than Kapital, Visitors or Ticket Buyers.

r)  Voucher 2026: represents a product purchased by the buyer that offers the possibility to participate in the next edition of the Festival

s)       Festival Area: any of the locations where the Festival takes place.

 

III. LEGAL RELATIONSHIP

3.1. These GTCs also present the obligations arising from participation in the Festival and the relations that are established between Kapital and the Participants on the occasion of the Festival, the latter being obliged to comply with them, the application of the GTC reaching the guarantee of safety and comfort of the GTC. 

3.2. The GTC must be read together with the Privacy Policy. GTCs will be posted both on the website www.kapitalfestival.com as well as at the entrance of the Festival. 

3.3. These GTCs set out the rights and obligations arising from the receipt of an Order Confirmation, the purchase of Products and participation in the Festival and the relations established between Kapital and the Buyer and the Participants.

3.4. By purchasing Products or participating in the Festival at the Festival, the Product Buyers and Participants accept and agree to comply with:

  • GTC and any obligations and responsibilities related thereto. Any Product Buyer and Participant who violates the GTC may be liable for legal action, refusal of entry to the Festival and/or removal from the Festival perimeter.
  • security measures, notices, requests or announcements posted or given by the Police, Security Personnel or agents representing any of the Associated Entities, including without limitation, all instructions or announcements relating to access and security to the Festival;
  • all national laws and regulations.

3.5. The Buyer and the Participant agree to indemnify the Organizer for any damages, losses, liability or prejudice that these parties suffer or may suffer as a result of the non-compliance with these GTCs by the Buyer and the Participant.

 

IV. TICKETS AND WRISTBANDS

4.1. Visitors are admitted to the Festival on the date and times as specified by the organizer. By purchasing a valid Ticket, each Participant ensures the right to participate in the Festival, with the obligation to know his/her rights and obligations within it.

 

TYPES OF TICKETS/Subscriptions for the 2026 Edition of the Festival

4.2. Participation in the Festival is made using one of the following types of Tickets

  1. Standard Subscription  (General Access) - guarantees the Authorized Participant access to the Festival for the entire period of its development.
  2. VIP Subscription  - guarantees the Authorized Participant access to the Festival for the entire duration of the Festival. VIP membership holders benefit from access to a specially designed area with bars with Premium beverage options. Access to the Festival for VIP season ticket holders is through a special entrance.

 

Important! The access of people under 18 years of age to the VIP area is strictly prohibited.  The Contractual Partners operating the VIP platforms will be able to establish differentiated access conditions on the platform, depending on the services offered by the Partner and paid for by the consumer.

 

C) One-day ticket - guarantees the Authorized Participant access to all the stages of the Festival on that day, starting with the opening time communicated by the Organizer and until the closing of the Festival on that day and for the other days the Participant no longer has access to the Festival.

D) UNDER 25 Season Ticket - guarantees access to the Festival for the entire period of its development to the Participant who meets the conditions of the "UNDER 25" program.

The products under the Under 25 Program are dedicated and available only to people who meet the following conditions:

  1. The person who purchases this subscription has not reached the age of 25 on the first day of the Festival, the date to be announced by the Organizer;
  2. He/she is enrolled in a form of education in Romania and can prove enrollment in a form of education in Romania by presenting a document attesting to this fact (card, certificate, etc.) and the identity card in order to verify the name and age of the person.
  3. At the time of the festival, the purchaser of the season ticket will present himself at the point marked "Accreditations", located within the festival, from where he will directly pick up his participation bracelet in the festival by presenting the identity card and the card or certificate proving the quality of pupil/student (the certificate from which the Personal Numerical Code (CNP) will be deleted by any means that ensures the indecipherability of the CNP,  e.g. erasing it with a marker).
  4. If the holder of the purchased Under 25 pass cannot prove that they are eligible, they will pay the difference between the full price of the pass and the price paid on the promotion pass. Otherwise, access to the perimeter of the Festival will not be allowed.
  5. These subscriptions are offered on a schedule basis and are carried out within the limit of available stock. Prices are displayed in the Tickets section of the website.

TYPES OF INVITATIONS

4.3. Participation in the Festival is also made using one of the following types of invitations (which will be assimilated to the Tickets):

A)  Standard Invitations (General Access) – guarantees the Authorized Participant access to the Festival for the entire period of its development, starting from the first day from the opening time communicated by the Organizer and until the end of the Festival.

B)  VIP Invitations – guarantees the Authorized Participant access to the Festival starting from the first day from the opening time communicated by the Organizer and until the end of the Festival. VIP guests have access to a specially designed area with bars with Premium beverage options. Access to the Festival for VIP guest holders is through a special entrance.

Important! The access of people under 18 years of age to the VIP area is strictly prohibited. The Contractual Partners operating the VIP platforms will be able to establish differentiated access conditions on the platform, depending on the services offered by the Partner and paid for by the consumer.

  1. One-day invitations – guarantees the Authorized Participant access to all the stages of the Festival on that day, starting with the opening time communicated by the Organizer and until the next day at the closing time, the time at which the validity of the Ticket ends, and the Participant no longer has access to the Festival.
  2. For the Festival 2026 Edition

 

Before announcing the date of the festival for the 2026 edition, the Organizer will issue vouchers that will be transformed into access tickets once the date is communicated. After this moment, the vouchers will become actual tickets that provide access to the festival.

 

TYPES OF VOUCHERS FOR THE 2026 EDITION OF THE FESTIVAL

4.4. Participation in the Festival is done using one of the following types of Vouchers that will turn into Tickets once the festival date is announced:

 

  1. Standard Voucher (General Access) Register/Pre-sale - guarantees the Authorized Participant access to the Festival for the entire duration of the Festival.
  2. VIP Voucher - guarantees the Authorized Participant access to the Festival for the entire duration of the Festival. VIP membership holders benefit from access to a specially designed area with bars with Premium beverage options. Access to the Festival for VIP season ticket holders is through a special entrance.

 

Important! The access of people under 18 years of age to the VIP area is strictly prohibited.  The Contractual Partners operating the VIP platforms will be able to establish differentiated access conditions on the platform, depending on the services offered by the Partner and paid for by the consumer.

 

 

SERVICES AND ACCOMMODATIONS

4.5. The organizer puts through the website a series of products that include services and accommodation or various packages that will be offered in collaboration with our contractual partners. Additional information regarding the detailed conditions applicable to the purchase of these Services will be provided by our Contracting Partners upon the purchase of the Services. The buyer of accommodation services must also comply with the rules and regulations of the purchased accommodation location.

4.6. The buyer of vouchers/tickets/subscriptions has the obligation not to display online images of them. 

4.7. It is strictly forbidden to sell or buy invitations.

4.8. We encourage people who enter the Festival Area using an invitation to donate an amount of money (in the places that will be signaled in this regard), an amount that will be used for charitable purposes, described in the specially arranged locations.

4.9. Tickets/Invitations provide access to the Festival only one person.

4.10. The Organizer reserves the right to modify the list of artists participating in the festival, both before and throughout the event. The tickets purchased for participation in the entire day of the event, as well as the subscriptions, offer the buyer access to the festival perimeter and not to a specific show/artist.

4.11. Each location within the festival perimeter has a limited capacity and access may be temporarily restricted in order to meet the safety rules in force.

4.12. Standard Tickets/Subscriptions may be modified into VIP Tickets/Subscriptions, with payment of a price difference, within the limit of available stocks.

4.13. In the case of the price of a ticket denominated in a currency other than RON, the reference rate was set in Dollars at the value of 4.9786 lei on 13.01.2025, 08 :44:57, of Banca Transilvania or in Euro at the value of 5.241 lei on 06.05.2025, at 17:31, of Banca Comerciala Romana.

4.14. The Organizer reserves the right to change the exchange rate and the price of the Tickets without prior notice. The change in ticket prices does not apply to tickets already purchased at the time the change occurs.

 

4.15. Additional Add-ONS services

4.15.1. Additional product or service options available exclusively to persons who have purchased a valid ticket for the Festival. 4.15.2. The list of available Additional Services, their description, conditions of use and related tariffs are published on the official platform of the Organizer and may be updated without prior notice.
4.15.3. Additional Services can be purchased through the official online platform, using the payment methods accepted by the organizer.
4.15.4. The purchase is considered completed at the time of payment confirmation by the payment processor.

4.15.5. Once purchased, the Additional Services cannot be cancelled, modified or refunded, regardless of the reasons given by the buyer.

4.15.6. Access to Add-Ons is nominal and may not be transferred to another person, except in cases expressly mentioned by the Organizer.

 

4.16. PAYMENT OF PRODUCTS AND PAYMENT OPTION IN INSTALLMENTS

4.16.1. Object. Tickets or Services can be purchased in two ways:

a) Full payment, which involves the payment of the entire amount related to the product in a single installment;

b) Payment in installments, which allows the total amount to be divided into monthly installments, according to the customer's option. Only the products expressly indicated by the Organizer on the Site as available to be paid in this manner can be purchased in installments.

4.16.2. The Customer will choose the desired payment method at the time of placing the order.

4.16.3. Installment payment mechanism. The number of available installments and their amount is indicated in the Organizer's platform and is determined according to the period remaining until the date of the event and the amount paid at the first installment. When selecting the installment payment option, the customer will indicate the desired number of installments, within the limit of the maximum available. Products purchased after June 1, 2026 are not eligible for payment in installments. The organizer charges a processing fee for using the installment payment option. Its value is 50 RON, it is paid at the time of selecting the payment option in installments and is included in the first installment. The processing fee is non-refundable, regardless of the reasons given. The Organizer reserves the right to update the amount of the processing fee, but any changes will apply exclusively to future transactions and will not affect the fees already paid.

4.16.4. Withdrawal of amounts. The first installment will be paid at the time of purchase of the Product with payment in installments. Subsequently, each installment will be automatically withdrawn from the bank card authorized by the customer in the platform, at an interval of 30 days between withdrawals. By selecting the installment payment option, the customer expressly consents to the automatic debiting by the Organizer of the installment amounts. The customer is obliged to ensure that there are sufficient funds in the bank account associated with the card used for the payment of the installments. 

If a rate cannot be successfully withdrawn, the Organizer will perform the following attempts: Three attempts on the first due day; An additional attempt on day 3; One last attempt on day 5. If the installment remains unpaid after the five attempts, the customer can make the payment manually through the platform. If the customer accumulates two unpaid installments, he will have a dedicated button available to contact the support team in order to solve the situation. 

4.16.5. Access to the product. No products purchased through the installment payment option will be available for use until the amounts due have been paid in full. After completing the full payment, the products become valid and can be used according to their destination. Specifically:

a) The products purchased in installments cannot be transferred to another user, and until the full payment of the amount due, online check-in cannot be performed, the bracelet related to the ticket cannot be delivered, and the QR code of the ticket or any other services associated with the purchased product will not be available.

b) The Client understands and agrees that, regardless of the number of installments paid, if the total amount related to the product is not paid in full by the established deadline, the Organizer reserves the right to cancel the order WITHOUT REIMBURSEMENT OF THE AMOUNTS ALREADY PAID, REGARDLESS OF THE REASON FOR NON-PAYMENT IN FULL.

4.16.6. Management platform. All payments are processed through the official platform of the Organizer, available on the Website. The customer's banking data is protected by security measures that comply with industry standards. The organizer reserves the right to modify the installment payment policy, without prior notice, in compliance with the orders already placed.

 

PROHIBITIONS

4.17. It is strictly forbidden to transmit or post series of tickets and/or subscriptions on social networks or other websites of this kind (e.g. Facebook, OLX, etc.).

4.18. Failure to comply with these provisions will result in the cancellation of the invitations/tickets or subscriptions sold and the prohibition of access to the festival of the persons involved in this operation.

4.19. IMPORTANT! It is strictly forbidden to sell or buy invitations and it is not recommended to purchase tickets or subscriptions except through authorized ticket sales platforms called Contractual Partners. 

THE ORGANIZER CANNOT GUARANTEE THE VALIDITY OF ANY TICKETS THAT ARE NOT PURCHASED THROUGH THESE CONTRACTUAL PARTNERS. IF ANY FRAUD IS DISCOVERED ON A TICKET, THE ORGANIZER RESERVES THE RIGHT TO CANCEL THAT TICKET AT ANY TIME (even if the holder of a fraudulent ticket has managed to go through the check-in or transfer process). THE ORGANIZER DRAWS ATTENTION TO THE FACT THAT A SERIES OF FRAUDS HAVE BEEN DISCOVERED THAT RESULTED FROM THE SALE OF TICKETS THROUGH UNAUTHORIZED CHANNELS, AND THE CONSUMER ASSUMES IN THIS CASE THE RISK OF PURCHASING A TICKET THAT WILL NOT ALLOW HIM ACCESS TO THE FESTIVAL. 

The organizer reserves the right to resort to legal channels to sanction those who will be found to carry out such activities, as well as to cancel the respective invitations/tickets/subscriptions.

4.20. The purchased tickets and/or subscriptions may be used for commercial purposes, such as for organizing promotional campaigns, offering tickets and/or subscriptions as prizes for competitions, etc., only with the prior written consent of the Organizer. Failure to comply with this obligation will result in the cancellation of tickets and/or subscriptions Used in purpose and to oblige the persons responsible to compensate for the damage thus created. At the same time, the organization of promotional campaigns through the use of tickets and/or subscriptions to the Festival, without the prior written consent of the Organizer, constitutes the violation of the intellectual property rights regarding the Kapital Brand.

 

CONTRACTUAL PARTNERS

4.21. Tickets may be sold directly to the Participants by Kapital or its Contractual Partners, and their payment is processed by the payment processor of Kapital or the Contractual Partners. The ticket authorizing participation in the relevant Festival is sold to the Buyer on the Site or by other Contractual Partners. The Organizer only guarantees the validity of the Tickets sold by or through the networks of these Contractual Partners.

4.22. Additional information regarding the detailed conditions applicable to the purchase of Tickets online or in physical format will be provided by our Contractual Partners at the time of purchase of the goods.

4.23. Our Contractual Partners sell Tickets at fixed locations and on online ticket purchase interfaces.

4.24. The Buyer/Consumer will receive information from the Contractual Partners in particular in relation to the following aspects: the taxes and commissions applied to the price set by Kapital, payment and payment methods, invoicing, processing of the Buyer/Consumer's data and possibilities of reimbursement, insofar as they exist.

4.25. The tickets accepted by the Organizer can be in physical format or in electronic format (eTickets) that are sent to you in the form of a QR code in My Wallet in your personal account, in an email or printed on paper, which each Participant has the obligation to bring with him to the event or to present it in original electronic format (on the phone,  tablet or other electronic devices that allow it). Attention! Photos taken on tickets are not accepted! Most customers of Contractual Partners receive tickets within 3-5 minutes after payment is successfully completed. If your ticket has not arrived by e-mail after 24 hours from the place of the order, you have the obligation to contact the platform from which you purchased the ticket within a maximum of 10 days from the purchase of the ticket, but no later than one day before the start of the Festival. Kapital is not responsible in any way for this kind of situation, and in the absence of a valid ticket, access to the Festival will not be allowed. 

 

OTHER FEES AND SERVICES RELATED TO TICKETS

4.26.1. The final price paid by the Buyer includes: the basic price of the ticket, the administration and processing fees, to which is added the VAT at the rate of 9%, and the difference up to 21% represents the Red Cross stamp duty of 1% and the taxes due to collective management organizations.

4.26.2. Kapital does not assume responsibility for administration and processing fees that may differ depending on the platform from which the ticket is purchased and the Contractual Partners from which the consumer/buyer purchases the goods. Kapital is not liable for the extra services provided by the Contractual Partners.

4.26.3. Participants who purchase tickets for the festival may request the issuance of a tax invoice within 5 calendar days from the end of the event. Requests submitted after this deadline will not be able to be processed. The invoice will be issued according to the data provided at the time of the request, and the organizers do not assume responsibility for incorrect or incomplete information sent by the buyer.

 

RISK FREE 

4.27.1. The additional Risk Free service offered by Kapital, which undertakes to return the value of the access ticket to the Buyer, if the Buyer cumulatively meets the following conditions: 

i) requesting its reimbursement within the term provided for in art. 4.26.2, 

ii) in case of no-show at the event, and 

iii) to the extent that the buyer has opted for this service and has paid the related taxes, as follows:

4.27.2. The Buyer may request a refund of the value of the purchased Risk Free Ticket at any time, but no later than 14 days before the start of the event.

4.27.3 Kapital undertakes to return EXCLUSIVELY the value of the ticket, without the Risk Free fee (set by the organizer in the range of 10-25 Euro) within a maximum of 30 days from the time of the request, if the Buyer has not changed his mind and has not used that ticket for access to the festival and if the request has been made within the deadline.

4.28. Except for the situations provided for in art. 4.26, the money on the Tickets purchased for this event is not refunded, the purchase of tickets for shows and entertainment activities being exempted from the application of the right of withdrawal regulated by GEO 34/2014. 

4.29. The Organizer does not assume responsibility for the loss or theft of the Ticket and/or subscription. The Organizer has no obligation to refund the amount of money or to replace the Ticket and/or Season Ticket in case of loss or theft of the Ticket and/or Season Ticket.

4.30. The Buyer expressly gives his consent for the Organizer to request and process the Buyer's home or residence address in order to send the festival access bracelet directly to the indicated address, in order to ensure access to the Festival in a more pleasant and efficient way. The Organizer reserves the right to offer this option to the Buyers for a fee, as an alternative to the option to pick up the bracelet from the location announced by the Organizer on the eve or during the Festival. If this service is available, the Organizer will complete this section.

 

4.31. CAMPANIA REFERRAL 

4.31.1. Any person who has an account on the Site can benefit from the campaign in the following way:

  1. In the personal account on the platform, the user will have access to a section called Referral where he will be able to view the benefits and mechanics of using the uniquely assigned code automatically.
  2. The unique code can be used exclusively for the purchase of subscriptions or products available by opening the Referral link. The unique benefit code is automatically applied to the recipient of the link and purchases a product.
  3. The unique code link can be used for a maximum of 10 orders (which can include multiple products purchased per order). Regardless of the number of vouchers/subscriptions purchased through the order, the Participant will receive the value in the form of a top-up for a maximum of 10 products (vouchers/subscriptions) purchased. 
  4. For each voucher/subscription product purchased, the Participant will receive a voucher worth 10 euros for each subscription. These amounts in the form of cashback can be used exclusively to be loaded on the bracelet or on the Festival ticket for the top-up used to purchase the products during the Kapital Festival 2026 by paying with the bracelet.

4.31.2. The amounts will be visible as a Reward in the Wallet only after the purchase of the products has been made and the payment has been collected by the Organizer.

4.31.3. The maximum amount earned by a Participant through these referrals is 100 Euro in the form of a top-up.

4.31.4. The cashback reward is only available if the Participant has a valid ticket to the festival and participates in it.

4.31.5. The participant has the obligation to use this amount in full at the Kapital Festival 2026 edition, as the amounts cannot be reported for future editions of the Festival, cannot be withdrawn at the end of the event (in whole or in part) and cannot be transferred back to the My Wallet. Thus, any amounts obtained by the Participant within the campaign that remained unspent will not be returned at the end of the Event through Online Refund or at the location. If for any reason the Festival will no longer take place in 2026, the Participant will not be entitled to the payment of the equivalent in lei of the equivalent of the amounts won or to any other kind of compensation.

4.31.6. The cash value of the voucher obtained within this Campaign cannot be awarded, respectively these prizes cannot be exchanged.

4.31.7. From the moment the value voucher is made available in the form of cashback in the User's Wallet, the Organizer is released from any obligation towards it.

 

5. CHECK-IN OBLIGATION

5.1. In order to be allowed access to the Festival Area, the holder of a valid Access Ticket has the obligation to check-in the purchased Ticket. The buyer of a ticket has the possibility to check-in in two ways: online or on-site (at the location).

5.2. Check-in can be done for a fee on-site (at the entrance to the Festival Perimeter) or free of charge under certain conditions provided in these GTCs and exclusively online (on the Website or through the application).

 

5.3. On-site check-in (at the event location)

5.3.1. On-site check-in will be carried out by the organizer's Contractual Partners, who use their own infrastructure and staff. Attention: On-site check-in can be done every day of the festival within the time interval communicated by the Organizer.

5.3.2. On-site check-in will be done in all situations for a fee to be paid at the ticketing points where the wristband will be issued based on the ticket. The fee for the check-in service at the location is in the amount of 25 EUR, and is paid at the time when the buyer presents himself with the original identity document.

5.3.3. Caution!! The scanning of the identity document (identity card/passport) is done only partially, being collected only data consisting of: name, surname, gender, country/place of origin, date of birth, nationality, and the photo on the identity document, without retaining the following data, such as: personal numerical code, series and ID number, photo of minors, or any other sensitive data. For more details on the personal data that is processed by Kapital, please read our Privacy Policy.

5.3.4. If the Ticket holder does not wish to have his/her identity document scanned, an operator will record the data provided by the person concerned on the basis of the original identity document presented on site.

5.3.5. Each valid Ticket holder, who has checked in and presented himself at the entrance to the Festival Area, receives a Bracelet (the color of which is depending on the type of Ticket purchased) to which the data collected during the check-in process are attached. After the process of exchanging the Ticket for a Bracelet, the Bracelet will confer the rights and obligations provided by the Ticket.

5.3.6. Kapital will register the Visitor's Bracelet during the entry procedure, provided that the Visitor has validly checked in the Ticket.

5.3.7. Bracelets are non-transferable.

5.3.8. Visitors are obliged to wear the Bracelets, during their period of validity, on their wrist or, in exceptional and well-justified cases, in another visible place, provided that the Bracelet cannot be removed without being damaged. The Festival organizers can inspect the Bracelets at the entrance, at the exit and on the entire perimeter of the Festival, throughout the Festival Duration.

5.3.9. The Visitor is fully responsible for any damage or loss of the Bracelet.

5.3.10. Damaged bracelets, which have been resealed or cut, whose closure system has been opened, those with a diameter larger than the wearer's wrist or which have been intervened in any way, are NOT valid, and the organizers reserve the right to retain such bracelets, to deny access to people in the festival and to complain about the situation to the competent authorities.

5.3.11. Kapital will not replace damaged or lost bracelets unless the Participant can prove the purchase of the ticket related to that bracelet legally. Participants who cannot provide this proof lose their right to be in the Festival Area, being excluded from it.

5.3.12. In case of loss, damage of any kind to the Bracelet, the Participant is obliged to purchase a new Ticket for that day if he/she wishes to remain within the perimeter of the Festival.

5.3.13. If the bracelet appears to have been fraudulently damaged, the Organizer has the right, in addition to the rights provided for in art. 5.3.9, to oblige the Participant to purchase a Day Ticket regardless of whether the Participant can prove the purchase of a ticket legally and regardless of whether or not he/she still wishes to stay in the Festival Area. This right can be exercised at your discretion, and depending on the availability of tickets for that day.

5.3.14. If, upon access to the Festival Area, the Ticket holder is suspected of illegally acquiring the Ticket, Kapital expressly  reserves the right to request the Ticket holder to present evidence (documents and/or certificates) verifying the legal acquisition or acquisition of the Ticket, as well as the right to assess whether they are valid and compliant,  and in the absence of a document refunding the purchase price and refusing the entry of that person into the Festival Area.

 

5.4 Check-in Online

5.4.1.  The Online Check-in process involves the registration/assignment of a valid ticket in an account created by the Visitor, through the Kapital website or application  and the provision of the personal data required for this process. The online check-in process is free only for the first 30 days of purchasing the ticket, after which a fee of 15 EURO is charged. Kapital encourages all Buyers to check in online at the time of ticket purchase to avoid paying additional fees and to ensure smooth access to the festival. The payment of the online check-in fee will be made through secure payment platforms.

5.4.2. The 30 days of free admission for Online Check-in are calculated starting from the day the subscription was purchased.

For example: if the customer purchased a subscription on 31.10, he has the possibility to do Free Online Check In until 29.11 (inclusive).

Online Check-In for Tickets Purchased Offline – Partners

5.4.3. The process to claim the ticket purchased from the offline environment is done by entering the personal profile and entering the electronic code in the Redeem section. After activating the code, the holder will receive the ticket in the My Wallet section and by email. 

5.4.4. Check-In is free of charge for the first 30 days after the purchase of the ticket. After this term, the user must pay the fee of 15 Euro for each Check-In made. The platform will automatically indicate how many days are left of the free period and the amount of the Check-In fee.

5.4.5. If, after claiming the ticket, the holder can no longer reach the festival, he/she has the option to transfer the ticket to another person, applying the provisions regarding Transfer and Online Check-In in this document. 

Online check-in for tickets purchased online

5.4.6. In order to make the online check-in, the holder of a ticket must log in to the account from which he made the purchase and access the My Wallet section where the purchased tickets will be displayed. The holder will have to select the ticket for which he/she is going to perform the Online Check-in and follow the steps indicated.

5.4.7. The User can check-in free of charge within the first 30 days after purchasing the ticket.

5.4.8 In the event that the User is no longer in the free period (the first 30 days after the purchase of the ticket), in order to carry out the Check-in, he/she will have to pay the equivalent of 15 Euro. If a User has purchased more than one ticket, he/she will have to pay the fee of 15 Euro, for each ticket.

5.4.9. After selecting the ticket, the user must upload a photo (ID type) and fill in the following data: name, surname, phone number, email, gender, date of birth, country, city, county. In the case of minors, as their photo is not processed, the Organizer will automatically set a general and impersonal image.

5.4.10. Users who are not yet 18 years old are required to download and complete the Parental Consent form. 

5.4.11. At the time of Online Check-in, the Visitor is solely responsible for the correctness of the data entered. The organizer has the right to verify on the spot whether the data entered by the visitor corresponds to the data on the visitor's identity card.

5.4.12. At the latest at the time of Online Check-in, the User acknowledges and agrees to the Terms and Conditions of the Festival, displayed on the Website.

5.4.13. If the User has purchased more than one ticket and wishes to check in for the other tickets, he/she may do so by passing for each ticket, the data of the persons who will use the tickets. The holder of the group of tickets is directly and solely responsible for the correctness of the data entered and will take the consent of each person for whom he checks in that they have read, understood and agree with the TCG and the Privacy Policy. 

 

6. TICKET TRANSFER POLICY 

6.1. The transfer of a ticket implies the transmission of the product by its current owner to another person who will take over the rights and obligations arising from its use.

6.2. Once the holder chooses to transfer the ticket to another person, he/she accepts and assumes that he/she waives all rights he/she had over the ticket. 

6.3. Check-In is free of charge for the first 30 days after the purchase of the ticket. After this term, the user must pay the fee of 15 Euro for each Check-in made.

6.4. The transfer of the ticket is made for a fee. The transfer costs are as follows:

  • Standard General Access - 75 lei
  • General Access 1-day ticket - 35 lei
  • VIP - 150 lei
  • VIP Day ticket - 75 lei
  • Standard General Access Invitation - 150 lei 
  • Standard General Access Invitation 1 Day Ticket - 70 lei
  • VIP invitation - 250 lei
  • VIP Invitation Day Ticket - 150 lei

6.5. Transfer is possible for tickets with or without Online Check-In.

 

  1. Transfer for tickets without online check-in:

To make the transfer, the ticket holder must log in to his account and select the Transfer button, being then automatically directed to the form for filling in the information of the person to whom the transfer is made.

 

B. Transfer for tickets with Online Check-In made:

To make the transfer, the ticket holder must log in to his account and delete the Check-In free of charge. After deletion, the owner will select the Transfer button and is directed to the form for filling in the information of the person to whom the transfer is made. 

 

6.6. In both situations, after the transfer has been made by the old holder, the new holder will have to follow all the steps for online check-in for the transferred ticket, free of charge or for a fee, in relation to the number of days from the moment of purchase of the ticket. If the term of 30 days from the purchase has been exceeded, the new holder who receives the ticket will pay the fee of 15 Euros.

6.7. If the ticket holder has deleted the Check-In but no longer wishes to transfer the ticket, the provisions related to a new Check-In remain valid.

6.8. In order to carry out the Ticket Transfer, the holder will have to fill in the data of the person who will receive the ticket (name, surname, telephone, etc.). 

6.9 A ticket that has also made Check In Online and Top Up Online, cannot be edited or transferred! 

6.10. The only ticket transfer mechanism from one holder to another authorized and recognized by the Organizer is this, through the official platform. QR code pictures are not supported!

6.11. Access to the event will be based on an identity document (identity card or passport) and a ticket with a valid QR/code.

6.12. For information and support, the user may send an email to ask@kapitalfestival.com. 

 

7. RHUNA AND USE OF ACCOUNT BALANCE 

7.1. General aspect

7.1.1. Rhuna, as defined in these Terms and Conditions, is used for the purchase of Rhuna products and services within the Kapital festival and on the Website.

7.1.2. Through the personal account on the Kapital platform (website or application), the user will be able to load an amount of money into the system by pressing the "Top Up Account" button which, with his/her consent, will be transformed into RHUNA and will be visible in the Account Balance section.

 

7.2. Use of Rhuna

7.2.1. Once the amount of money has been deposited into the Account Balance and converted into RHUNA, the user will be able to use this tool to: 

  1. Purchase of Rhuna products and services.
  2. Loading on the ticket and on the access bracelet for the purchase of products and services within the festival.

 

7.3. Validity and withdrawal of Rhuna

7.3.1. The RHUNA loaded into the Account Balance has a validity period until December 31 of each year related to the festival edition. After this term, the amounts existing in the Account Balance will expire.

Example: The money converted into RHUNA for the Kapital 2025 Festival remains valid for the purchase of products and services, until December 31, 2025. The money added to the personal account in 2026 will be valid for the purchase of products or services until December 31, 2026.

7.3.2. After converting the amounts of money into Rhuna, the user can no longer convert Rhuna into its cash equivalent and/or withdraw the converted amount, except in exceptional circumstances (death, inability to use the account for a long period of time, proven by supporting documents).

 

7.4. Rewards System

7.4.1. The Organizer may grant certain benefits in the form of advantages and rewards that can be used for the purchase of Rhuna products and services during the festival, on the Kapital platform or to perform online top-up on the ticket.

7.4.2. These benefits, called Rewards, have the following characteristics:

  • They cannot be withdrawn. Rewards cannot be converted to cash and withdrawn from your account.
  • They cannot be turned into their equivalent in money.
  • Expires after the completion of the festival edition for which they were awarded. Example: If the user received a reward on the Kapital Festival in March 2025, it can be used until the last day of the Kapital Festival 2025.
  • The cash equivalent of the Reward will be withdrawn with priority in the case of the purchase of Rhuna or top-up products and services. Example: If the user has received a reward for the 2025 edition of the Kapital Festival and has additionally loaded an amount of money into the Account Balance, when purchasing a product, the value of the Reward will be used first, then the amount of money loaded.

7.5. Payment processing

7.5.1. The Kapital Platform uses the services of Banca Transilvania to load the amounts of money into the Account Balance that are converted into Rhuna.

7.5.2. Online payment with your personal or company card can be made in complete safety. The cards accepted for payment are those issued under the VISA (Classic and Electron) and MASTERCARD (including Maestro, if they have a CVV2/CVC2 code).

7.5.3. Payment is based on a secure online transaction processing system that provides confidentiality, security and simplicity in the purchase of products and services over the Internet. The processing of card data is done exclusively through the bank.

7.5.4. The Organizer is not responsible for any technical or system errors that may affect the operation of the Account.

7.5.5. The User is responsible for the security of access data to the personal account and for all activities carried out under his/her account. The organizer is not responsible for unauthorized use of the user's personal account.

 

8. TOP UP ONLINE

8.1. Top Up Online is a service offered by the Festival to users, which allows them to load their festival ticket with money by online payment or by transfer from My Balance, and the respective amount will be transferred to the festival bracelet. This service is only available to users who have completed a valid online check-in.

8.2. Top Up Online can only be done from cards that have 3D Secure enabled.

8.3. Pre-festival Online Top Up – for users who have completed the Online Check In

  1. After online check-in, the ticket becomes available in the Account Balance area and you will be able to Top Up by activating the "Top Up Details" button.
  2. The user can select different top up options:
  • One-time transfer from the user's account: The selected amount that they want to load on the bracelet is transferred only once.
  • Auto top up when the balance drops below a certain value: By activating the option, when the credit drops below a certain amount set by the user, the ticket in the account is automatically loaded with the set amount, taking money from the Account Balance or from the card, if the Account does not have enough funds.
  1. The user will be transferred to a secure payment page, where they will need to enter their card details and the 3D Secure verification code.
  2. After successful payment, the user will be able to view the total amount deposited on the ticket.
  3. After completing the online Top Up, the amount of money on the bracelet will have to be activated at any of the merchants inside the Festival or at Credit Points.
  4. After activating the top up, the User can spend the money in the Festival, at any time, for the entire period of the festival.
  5. If the user has spent all his money, he can repeat the same steps described above to recharge his bracelet or he can go to any charging point - Credit Point inside the festival.

 

9. PAYMENT METHOD WITHIN THE FESTIVAL 

9.1. The payment method for the Products and Services offered in the Festival Area is through the multi-use vouchers used using the payment devices (RFID), made available by Kapital, through the Festipay service, respectively their activation on the bracelet.

9.2. The participants have the obligation to use in the Festival Area only the payment methods and instruments established by the Organizer.

9.3. Upon entering the Festival Area, each Participant will receive a Bracelet (having the integrated payment system) with which they can purchase the Products and Services available within the Festival. Cash payment in the Festival Area is strictly prohibited, outside the Credit Point areas previously established by the Organizer.

9.4. These payment instruments are considered MPV (multi-purpose voucher = multi-purpose vouchers), as defined by the European Commission, due to the fact that in exchange for the Credit Points on the payment instrument, the Participant can purchase services/products that have a different VAT rate. In this case, VAT is collected when using credit points. At the same time, the issuance of a tax receipt and/or an invoice for the purchased Product/Service is the responsibility of the merchants (Contractual Partners). If a Participant wants a tax invoice for the Products/Services purchased during the Festival, he/she has the obligation to keep all the tax receipts from each merchant (Contractual Partner) in order to subsequently request the tax invoice from the respective Contractual Partners.

9.5. The Organizer has the possibility to provide the Visitors with proof that the transaction (deposit or withdrawal of funds) has been carried out.

9.6 The procedure regarding transactions in the electronic system during the Festival is as follows:

  1. At the entrance to the Festival Area, after obtaining the Bracelet, it is recommended that each Participant go to one "Credit Points" to charge their Bracelet with credit points.
  2. The bracelet will be the only payment method during the Festival.
  3. The conversion for this MPV (multi-purpose voucher) is: 1 leu – 1 credit point.
  4. For each load, the Organizer has the possibility, but not the obligation, to give the Participant a proof of the amount deposited on the Bracelet.
  5. Damaged Wristbands may be deactivated and replaced with other Wristbands at the Help Desk - Credit Point, located in the Festival Area, throughout the Festival Duration, taking into account the provisions of point 5.3.11.  
  6. After obtaining a new Bracelet from the Help Desk – Credit Point, the amount held by the Participant on the damaged Bracelet will be transferred to the new Bracelet.
  7. Participants have the possibility to charge their bracelet as many times as they want, but each charge must have a minimum amount of 1 leu.
  8. The participant has the right and possibility to check the amount available on the Bracelet at any Contractual Partner in the Festival Area or at the Credit Point.
  9. The Bracelet can be charged/recharged either by cash, by bank card or by the Website (for bank cards issued under the Visa, Visa Electron, Mastercard, Maestro logo issued by any bank in the world), according to the "Top Up Online" Chapter of these Regulations.
  10. In the case of top-ups/re-top-ups of the Bracelet through the Website, the Participant assumes full responsibility for the card data entered into the platform.
  11. At the first payment made by bank card, the 3D Secure security code will be requested. If the first payment is authorized, subsequent payments can be made without the 3D Secure security code. 

9.7. No commission is charged for payments by bank card!

9.8. Purchase of Products/Services from Merchants (Contractual Partners):

  1. The Participant chooses the desired Product, at which point the respective Contractual Partner ticks the amount in the POS;
  2. Each Participant has the obligation to check the amount checked by the Contractual Partner in the POS, and after verification he will touch the chip on the Bracelet on the POS - contactless terminal (card-reader) to make the payment;
  3. The Contractual Partners will have the obligation to issue tax receipts to the Customer Participants (and invoices, at the request of the Participants).

 

10. REFUND – Return of the money left on the Bracelet, at the end of the Festival

10.1. The REREFUND is the action by which a festival-goer recovers the money left on the bracelet, under the conditions detailed in these Regulations.

10.2. The unused amounts on the RFID bracelet can be exchanged for money, through the process called REFUND, if all the conditions imposed by the Festival are met.

10.3. In the event that the festival-goer has not withdrawn the unspent amounts from the bracelet or has not taken an action by which he requests the redirection in the Account Balance, the return to the card or the donation of the amount by the announced date, these amounts become the property of the Festival.

 

10.4 The refund can be made in the following ways:

 

10.4.1. REFUND AT THE LOCATION

10.4.1.1. Return of the amounts at any of the loading points on the Festival perimeter, at any time during the festival, but no later than the date and time communicated by the Organizer, from the Ticketing point outside the Festival perimeter.

Any request made after the announced date will not be considered by the organizer. In this situation, the organizer cannot be held responsible for the non-refund of the amount, being the exclusive duty of the festival-goer to comply with the deadline. WE RECOMMEND FESTIVAL-GOERS TO REQUEST A REFUND NO LATER THAN THE TIME THEY LEAVE THE FESTIVAL ON THEIR LAST DAY OF PARTICIPATION.

10.4.1.2. The amount returned represents all the amount remaining in the RFID Bracelet account (including those resulting from online transactions).

10.4.1.3. In order to carry out the Refund, the festival-goer must wear the bracelet on his hand and make sure that it does not show traces of compromise (except for the cases agreed by the Festival and presented in these Regulations).

10.4.1.4. If the client has made the Top Up using a bank card, the maximum amount that he can withdraw cash cannot exceed 2000 LEI.

10.4.1.5. For situations where the balance of the bracelet is greater than 2000 LEI, the client will have to present at the HelpDesk the receipt issued by the bank POS, with proof of deposit of the amount. The customer will fill in a refund request for this amount, which will be sent to the banking partner. The processing of the refund can take up to 14 business days. The amounts requested by filling in the form will be returned to the account from which the initial payment was made.

10.4.1.6. Cardboard ticket holders can present themselves for a refund exclusively at the points at the location. 

10.4.1.7. The festival-goer also has the option to donate the remaining amounts on the bracelet to a cause supported by the Organizer under the conditions set out above in point 10.4.1.1.

 

10.4.2. REFUND ONLINE

10.4.2.1. The Online refund process is carried out through the user's account, in the Account Balance section. The festival-goer will press the "Refund" button and will have the option on the platform to select one of the following actions regarding the amounts on the ticket:

  1. Directing back to the Account Balance. The amounts in the Account Balance can be used to load the ticket to a new event or to purchase products and services.
  2. Donation of the amount to a cause supported by the Organizer.
  3. Return the amount to the card with which the load was made.

10.4.2.2. The online refund process refers to the return of amounts ONLY from online transactions. The return will be made by expressing an option starting with the period and time interval communicated by the Organizer, as indicated in the platform. Any request made after this date will not be considered.

10.4.2.3. In this situation, the organizer cannot be held responsible for the non-refund of the amount, being the exclusive duty of the festival-goer to formulate the refund request within the given term.

10.4.2.4. For the online return of unused amounts, a fee of 5 RON – processing fee is charged, automatically withdrawn from the festival account. There is no charge for directing amounts back to your Account Balance. 

10.4.2.5. If a user has made the Pre-Festival Top Up and wants a refund before the start of the Festival, he/she will be able to do so only in exceptional situations, punctually analyzed by the Organizer.

10.4.2.6. The festival-goer is permanently displayed, within the account created by him, the amount of money he has left in total on the bracelet and which he can request through ONLINE REFUND.

10.4.2.7. The festival-goer also has the option to donate the remaining amounts on the bracelet to a cause supported by the Organizer under the conditions set out above in point 10.4.2.2, by selecting the "Donate" button within the ONLINE CHECK-IN & TOP-UP account.

 

10.5. REFUND order for the situation in which the top up was made with more than one bank card.

Each transaction is associated with a bank card. If two top-up transactions are made from two different cards, the money will first be debited from the first top-up card. For example, if 100 Ron is first loaded from one card and then 100 Ron from a different card, and 80 Ron is spent in the festival, the rest of the amount remaining in the bracelet account will be 120 RON. At REFUND, 20 RON will be refunded for the first transaction (the first card from which the online top-up was made) and 100 RON on the second card, respectively for the second online transaction.

10.6. REFUND in the event that the festival-goer has made both an online top up, but also a top up at the location:

In the event that there are unspent funds on the bracelet, the online refund is possible only within the limit of the available online balance, visible in the application, i.e. from the remaining funds from the amount uploaded through the online top-up. The rest of the amounts from the charging at the location can be withdrawn only at the charging points within the festival, until the date announced by the Organizer at the latest.

 

11. REGULI GENERALE DE ACCESS LA FESTIVAL

11.1. Entry to the Festival is possible only through the seats and at the established times, exclusively for Authorized Participants.

11.2. Access to the Festival Area is made only at the specially arranged entrances, in compliance with the registration procedures of the purchased Tickets, the check-in and access rules, provided by these GTCs.

11.3. In order to reduce the crowding created in the access area, as well as the discomfort of the participants, two entrances per day to the festival will be allowed.

11.4. Access to the Festival Area will be made according to the type of ticket purchased.

11.5. Participants are obliged to carry identity documents in addition to the Ticket.

11.6. At the request of the security team or representatives of the Organizer or other competent bodies or authorities, the Participant has the obligation to present access documents and identity documents.

11.7. These GTCs will be displayed in a prominent place at the entrance to the Festival and in other public areas within the Festival.

11.8. In order to ensure the safe conduct of the Festival, Kapital reserves the right to restrict the type of objects that can be brought into the Festival area.

 

This list is not exhaustive, the organizer having the right to prohibit access to the festival to the extent that the object owned by the participant could endanger the safety of other participants or would pose a danger to the safe conduct of the event. 

 

Therefore, it is forbidden to enter the Festival with the following objects: 

  • Drugs, substances whose consumption is prohibited or any kind of psychoactive substances;
  • Accessories for the consumption of the substances described above;
  • Bottles (including but not limited to PERFUMES, sprays or deodorants);
  • Flammable cosmetics (sun cream is allowed);
  • Backpacks or purses larger than 29 cm x 21 cm x 12 cm;
  • Beverage cans;
  • Preserve;
  • Artifacts; 
  • Lasers;
  • Sprays or corrosive/flammable substances, paints or containers with noxious or flammable substances;
  • Banners supported by sticks;
  • Chairs;
  • Weapons or any objects that can be adapted as weapons or projections;
  • Knives, blunt objects or any objects with a sharp point or sharp edge;
  • Chains or objects that have chains attached (such as wallet, pants, etc.);
  • Torches, smoke bombs or any other pyrotechnic articles;
  • Food or drinks;
  • Animals;
  • Umbrellas of any kind or shape (in case of rain, capes will be used);
  • Flammable or explosive materials;
  • Professional photo or video cameras, including any type of DSLR or detachable lens camera;
  • Any type of objects that may injure other Participants.
  • Drones;
  • Speakers, amplifiers or audio systems;
  • Devices that produce sound, operated electronically, mechanically or manually, such as megaphones or vuvuzelas, musical instruments;
  • Selfie stick sau trepied;
  • Lasers;
  • Any substance that is flammable; 
  • Any offensive, racist, xenophobic materials that promote sexual discrimination, religious, political or other illegal/prohibited materials, discriminatory propaganda messages;

 

Access is allowed with: 

  • Compact cameras;
  • Lighters;
  • GoPro Rooms;
  • Selfie sticks (small in size and made of lightweight materials);
  • External, portable batteries;
  • Lipsticks or lip balm;
  • Beach cream;
  • Non-flammable perfume or deodorant in containers smaller than 50ml;
  • Bottles.

 

Access with: prescription medications, insulin, drops – medical use, asthma inhaler spray is allowed only if they are accompanied by a medical letter or any other document replacing it and in the maximum recommended daily quantity.

 

11.9. As a result of the very strict rules regarding prohibited objects, the persons responsible for the security and monitoring of the Festival will search each Participant in detail and any prohibited objects discovered following the verification will be stopped at the gate, without the Organizer assuming responsibility for them.

11.10. All Participants are advised to consult the list of prohibited items and not to have such items on them during the Festival.

11.11. With regard to lost objects, the Organizer will arrange a special space where such objects can be brought and from which each owner can recover his belongings within 72 hours, but no later than the first day after the end of the Festival - at the time announced by the Organizer.

11.12. The Organizer has the possibility, but not the obligation, to photograph the lost objects and to display them on social networks, as the case may be, to the extent that this action would not violate the legal norms on the protection of personal data.

11.13. After the first day after the end of the Festival, the time announced by the Organizer, all unclaimed objects will be handed over to their issuers (example: identity card, birth certificate, etc., to the attention of the Municipal Police; bank cards to the attention of the issuing banks). Objects without an identifiable issuer, regardless of value, will be donated for charitable purposes, to the extent possible and according to the nature of the objects.

11.14. The Organizer is not responsible for the Participants' property or for any damage caused to them.

11.15. It is forbidden to enter by car, rollerblades, skateboards, bicycles, hoverboards, as well as other similar goods in the Festival Area.

11.16. For the convenience of the participants, the organizer reserves the right to temporarily stop access to certain areas, if it considers that the areas have reached their maximum authorized capacity.

 

12. MINORS AND PERSONS WITH DISABILITIES

12.1. Minors are prohibited from consuming alcoholic beverages, cigarettes and drugs.

12.2. Minors will receive bracelets of a different color, which will allow them to be identified more easily.

12.3. Minors under 7 years of age have free access to the Festival, in the company of a parent. At the request of the persons responsible for security and monitoring, as well as of the representatives of the Organizer, the companion has the obligation to present documents such as: student card, passport or any other document containing the minor's photo, attesting to his age.

12.4. Attention! Access for minors under the age of 7 is allowed only in the company of a parent and is recommended to be done by 19:00.

12.5. The access of minors between 7-14 years old will be made only on the basis of a valid Ticket and no longer in the company of a parent.

12.6. A parent may accompany only one minor under the age of 14.

12.7.  Access for minors between 14-18 years old will be made only on the basis of a valid Ticket, identity document and declaration of commitment. 

12.8. It is necessary for an adult to assume responsibility for a minor and has the obligation to fill in and sign the "Declaration of Commitment" available on kapitalfestival.com/parental agreement, without which the minor will not be allowed to enter the Festival Area, regardless of whether he or she has a companion or not.

12.9. The responsible person will provide in the statement of commitment contact details at which he can be contacted in cases of emergency.

12.10. The Organizer does not assume any responsibility regarding the verification of the signatures, respectively the manner of signing the declarations, these aspects remaining the responsibility/responsibility of the persons presenting the declarations.

12.11. In some areas of the Festival, the access of minors under 18 years of age is strictly forbidden (for example: VIP area).

12.12. Due to the very loud noise produced during the Festival, the Organizer does not recommend the presence of children under 7 years old at the Festival.

12.13. Minors under 4 years of age must wear soundproof headphones.

12.14. Exceptional situations when discounts/gratuities are granted to a certain category of minors or other Participants, will be reported on the website (e.g. e-Tickets), and are sent to you as an attached PDF in an email that each Participant has the obligation to print and bring with him to the event, or to present the ticket in electronic format (on the phone,  tablet or other electronic devices that allow it) when checking in at the location. 

12.15. Most customers of the Contractual Partners receive the PDF tickets or a QR code in about 3-5 minutes after the payment is successfully completed. If your ticket has not arrived by email after 24 hours from the place of the order, you have the obligation to contact the platform from which you purchased the ticket and to solve this problem within 5 days from the purchase of the ticket, but at the latest one day before the start of the Festival. Kapital is not responsible in any way for this kind of situation, and in the absence of a ticket, access to the Festival will not be allowed.

12.16. In the case of persons with disabilities classified in a disability category, they and their companions (if the need for the companion has been established by an evaluation commission and can be proven by a document issued by a competent authority or has been recorded in the certificate of registration in the degree of disability), benefit from the following facilities within the limit of 150 passes for the festival days:

a)      Children with disabilities and their companions benefit from a subscription free of charge;

b)      Adults with severe disabilities and their established companions benefit from a subscription free of charge;

c) Adults with severe disabilities benefit from a subscription free of charge;

12.17. In order to benefit from free of charge, adults with disabilities (or in the case of minors, their legal representatives) must send an application expressing their desire to participate in the festival and a declaration on their own responsibility stating the classification of disability to hello@kapitalfestival.com. In case of requesting the companion subscription, the Organizer may request additional documents attesting that the companion has been established according to the law. If persons with disabilities will benefit from a subscription ticket, they will receive an e-mail from the Organizer in this regard. These persons are subsequently obliged to present in original, at the access point mentioned in the confirmation email received, the certificate of disability and the identity card for verification.

12.18. Free access for people with special needs is made only on the basis of the identity document, the certificate of disability and the confirmation received by e-mail from the Organizer.

12.19. Incomplete applications and/or applications sent to other email addresses will not be considered.

12.20. The Organizer reserves the right to deny access to the festival to persons with disabilities who do not present these documents in original, as well as if the representatives of the Organizer have justified doubts about the validity or authenticity of the documents presented.

12.21 !!! The registration period to benefit from the free admission for the 2026 edition, provided for in art. 9.11 is 01.11.2025 – 01.05.2026 by sending an e-mail to hello@kapitalfestival.com. All applications submitted outside of this period will not be considered.

12.22. Taking into account that this facility can be granted only within the limit of a limited number of seats, considering the total capacity of the Festival as well as the safety and security rules, the gratuity will be granted according to the order of receipt of the requests.

12.23. At the time and to the extent that the number of 150 applications that comply with the conditions specified above is reached, the Organizer will display in these GTCs that the maximum number of tickets granted free of charge to persons with disabilities has been reached, and from that moment the Organizer will no longer respond to requests made in this regard.

12.24. The Organizer will respond to these requests within 30 days from the date of making the requests.

12.25. Persons with severe disabilities assume the obligation to always come accompanied to the Festival, for reasons of personal safety.

12.26. The organizer recommends all minors and people with disabilities to come accompanied to the Festival.

12.27. The Organizer will not be held responsible for any incident or accident involving minors or persons with disabilities. The entire responsibility for them lies with minors/persons with disabilities and/or parents/legal representative or companion. The organizer draws the attention of the parents/legal representative or persons exercising parental authority to the fact that they have the obligation to supervise the minor and will be held liable for any damage resulting from the failure to comply with this obligation.

12.28. To the attention of people with locomotor problems, who use a wheelchair for movement: only in certain areas of the Festival there are entrances with wheelchair facilities, which are marked on the Festival map.

12.29 According to 12.23, the Organizer announces that the maximum number of 150 complimentary tickets allocated for persons with disabilities has been reached.

 

13. BEHAVIOR DURING THE FESTIVAL

13.1. In the Festival Areas, visitors are obliged to refrain from all actions, statements or behavior that may endanger the life, health or physical integrity of other persons or that may violate their personal rights.

13.2. Any form of economic, commercial or advertising activity in the Festival Area – including in the area in front of the Festival gates – is prohibited without the prior written permission of Kapital. If the Organizers find that such activities are carried out within the perimeter of the festival, they reserve the right to remove the persons concerned and to prohibit their access to the festival.

13.3. The sale of alcoholic beverages must comply with the provisions of the law, and no such beverages may be offered to minors under 18 years of age and intoxicated persons by any vendor within the Festival. The serving of drinks (soft or alcoholic) by the organizer's Commercial Partners will be done exclusively in open containers (aluminum or plastic).

13.4. The use of substances qualified as drugs is prohibited in the Festival Area and is punishable by law. The Organizer reserves the right to cut off the bracelet of that Participant who violates this provision, to remove him from the Festival premises and to no longer allow him access, requesting the intervention of the competent bodies in this regard. 

13.5. Kapital reserves the right to introduce a system at the Festival whereby alcohol can be offered to Visitors only if the respective Visitor presents a certificate or document showing that he/she has the right to consume alcohol (e.g. identity card attesting to age).

13.6. Any demonstrations of any nature, which are not related to the Festival organized by Kapital, regardless of the number of participants, are prohibited, if Kapital has not given its prior written approval in this regard. This approval is granted by Kapital at its own discretion, based on the prior request of the organizer of the respective demonstration. If an approval is obtained, participants are obliged to comply with these GTCs and to behave in a manner that does not disturb, prevent, limit or make impossible the entertainment of other Visitors, the ability to move around the Festival area, access to the Festival area or the ability to leave the Festival area,    as well as the use of the Services and/or Products by other Visitors/Merchants.

13.7. Kapital has the right to terminate demonstrations (both those that it has authorized in accordance with the above and those that it has not expressly authorized), without giving a reason to do so. Kapital has the right to determine the conditions of the demonstrations, in particular the number of participants, their location and duration,  at his own free choice. If Kapital declares the end of a particular demonstration, participants are obliged to stop the demonstration immediately. If Kapital sets conditions for an authorized or recognized demonstration as described above, participants are required to fully comply with these conditions.

13.8. In the Festival Area, the authorized and appropriately qualified employees of Kapital or its Contractual Partners, as well as the employees or collaborators of the Partners, will ensure the application of the rules of conduct and safety. Visitors expressly undertake, by virtue of their participation in the respective Festival, that they will fully cooperate with such persons within the limits of the law and will comply with their instructions within the Festival in case of emergency or if other significant circumstances (e.g. for reasons of public health) warrant it.

13.9. At the Festival, both free Services and Products can be used, as well as Services and Products for which it is charged 

payment. Visitors undertake to pay for all Services and Products for which payment is charged, and assume responsibility for the immediate payment of all prices and purchase fees due.

13.10. Visitors will make payment for the Products and Services for which payment is charged using the payment methods offered by Kapital or the Contractual Partners. If Kapital so decides in relation to any area of the Festival, all prices and purchase fees will be payable exclusively by the methods designated by Kapital, instead of cash. 

 

14. VIDEO SURVEILLANCE AND PROCESSING OF PERSONAL DATA

14.1. For security reasons, the Festival Area is monitored with video cameras by Kapital's Contractual Partners. The processing of your personal data collected by the video surveillance cameras takes place whenever you are inside the festival, and by participating in the Festival the Participant explicitly gives your consent to this processing. Also, the concerts as well as the entire festival may be video/photo recorded by our contractual partners, for marketing and advertising purposes, as mentioned in chap. XV.

14.2. The categories of personal data processed, the means, the purposes of the processing, as well as the entire policy of Kapital regarding the processing of personal data are found in the Privacy Policy of the Kapital 2026 Festival available in the Privacy Policy section.

14.3. According to EU Regulation 679/2016 (GDPR) you benefit from the right of access, rectification, the right to obtain the deletion of data or restriction of processing, the right to data portability, the right to object, the right not to be subject to a decision based exclusively on automated processing.

14.4. In order to exercise these rights, you may contact Neversea Production S.R.L. with a written, dated and signed request to dpo@kapitalfestival.com.

14.5. If you believe that your personal data is being processed other than in accordance with applicable law, please contact us at dpo@kapitalfestival.com email address or you can contact the National Supervisory Authority for Personal Data Processing.

14.6. For more details regarding the processing of personal data, we encourage you to consult the Privacy Policy available on the Website.

 

15. HEALTH AND SAFETY

15.1. Taking into account the scope of the Festival, the Organizer will take the appropriate measures, so that the Participants are informed about the prevention and protection measures and activities within the Festival Area.

15.2. Each Participant has the obligation to behave civilly towards the other Participants of the Festival.

15.3. To the extent that the Organizer considers that a Participant endangers the safety of the other Participants or creates a situation of discomfort for them or behaves in a manner that affects the smooth running of the Festival or the atmosphere of the Festival, the Organizer reserves the right to cut off the bracelet of that Participant and to request the assistance of the Gendarmerie or the security company to escort that Participant out of the Festival and to no longer allow him access back to the Festival.

15.4. Government agencies, MIA institutions or other authorized bodies may provide the Organizer with negative advice regarding the access of a ticket and/or season ticket holder to the Festival. In this case, the Organizer is entitled to refuse entry to the Buyer's perimeter of the event, and the latter will not have any right of compensation.

 

16. RECORDINGS MADE DURING THE FESTIVAL

16.1. By purchasing a ticket and attending the Festival, the Product Buyer agrees to be photographed, filmed or recorded by the Organizer, the venue management or any third party operating on behalf of the Organizer within the Festival or in the immediate vicinity of the entrance to the venue. In addition, by purchasing a Product, the Product Buyer consents to photos, video or audio recordings with you. at the Festival or in the immediate vicinity of the venue entrance ("Recorded Material") made by the Organizer, the venue management or any third party operating on behalf of the Organizer. You hereby agree that the Organizer, venue management, or any third party operating on behalf of the Organizer may use the Recorded Material in any manner it deems appropriate, without restriction, approval, or reward in this regard.

16.2. The Organizer has the image rights over the entire Festival and may use the photo and video images, taken both by its own staff and by the participants, in various materials made during the Festival.

16.3. Participants acknowledge that Kapital, its Kapital-authorized contracted Partners, associates, members of the press, other visitors and other third parties may produce audio recordings and images of the Festival. Therefore, the Participants, by purchasing a Product and by virtue of their participation in the Festival, grant the Organizer permission to record and publish their image, appearance and actions in accordance with Article 16.1.

16.4. Kapital and persons authorized by Kapital have the unrestricted right to make a profit, use (in particular for the purpose of promoting the Festival), copy, publish, publicly broadcast and distribute such recordings of the Visitors, without having to pay the Visitors for it. 

16.5. Visitors expressly note that Kapital may record the Festival, concerts and programs, copy the recordings and distribute them through image-bearing means, broadcast them or otherwise make them public and do so repeatedly, including by informing the public about the Festival,  concerts and programmes, by means of cable data transmission or by any other means (e.g. via YouTube), so that members of the public can individually choose the place and time of access. 

16.6. Visitors are not entitled, within the limits of the legal provisions, to raise claims against Kapital in relation to their recordings and publication in accordance with the above. 

16.7. Visitors may not, without the prior consent of Kapital, sell, use for a price or use free of charge for commercial purposes, the image and voice recordings they have made, identify the Visitors appearing in such recordings without their consent, or infringe the personal rights of other Visitors. 

16.8 The Organizer reserves the right to establish prohibited areas/locations with photography/filming. In case of non-compliance, the Organizer has the right to delete such registrations. 

 

17. LIMITATION OF LIABILITY AND FORCE MAJEURE

17.1. Kapital does not provide any guarantee regarding the possibility of entering the Festival at the desired time or the possibility of attending the concert at the previously announced time and explicitly excludes the refund of the price of the Product, the granting of an additional discount or the payment of any damages or compensation as a result of these facts.

17.2 Kapital recommends all participants to check-in online at the time of ticket purchase and to come to the Festival at least a few hours before the concert they wish to attend. 

17.3. Kapital reserves the right to modify, restructure and further develop the Festival, Services and Products offered within the Festival, including but not limited to changes in the program (artistic, organizational, etc.), changing the location where the Festival takes place, at its choice. The Participants are not entitled to any claim against Kapital in relation to such modifications, restructurings or further developments. However, Kapital will make every effort to provide the Communicated Programs and Services and, if their provision becomes impossible, to replace the canceled Program or previously Communicated Service with another Program or Service.

17.4. Therefore, Kapital will not guarantee to the Visitor the availability, content, quality and quantity of the programs and Services (such as the evolution or appearance on stage of a particular artist, the fact that the evolution of a certain artist will live up to the expectations of the Visitor, or the opportunity to participate in a certain artistic program and/or at a certain location). These elements can take shape depending on the special characteristics of the location, the extraordinary situations that have occurred and the equipment present within them (such as the number of places in a given location). 

17.5. Kapital has no obligation to cancel the Festival in case of bad weather, however, if the authorities request the suspension or closure of the Festival by Kapital due to fortuitous circumstances or force majeure, the Festival or a part of it will be canceled/suspended, and Kapital cannot be held liable to festival-goers or other third parties for its closure/suspension. 

17.6. Participants expressly note that they may also purchase Products and Services in connection with the Festival that are offered by other Contractual Partners, and not by Kapital. In such cases, the contract is concluded directly between the Visitor and the Counterparty, and the rights and obligations arising from the legal relationship apply exclusively to the Visitor and the Counterparty. 

17.7. Kapital shall  not be liable for damages arising from or suffered in connection with the purchase or use of Services and Products provided by the Contractual Partners or for damages of any nature suffered by visitors as a result of participating in artistic moments or subsidiary activities within the Festival. 

17.8. Visitors will enter the Festival exclusively at their own risk, being responsible for the damages suffered by them or caused to other participants on the premises of the Festival. Kapital will only be liable if such damages are caused exclusively by Kapital and could not have been avoided by the Participant by taking due diligence in this regard.

17.9. Lost and found items can be handed over to the information desk indicated on the map. Visitors may inquire about lost items at the same office.

17.10. Participants are fully liable, both under civil and criminal law, for any damage caused  by Kapital, its Contractual Partners and other Visitors and Third Parties within the Festival or in connection with the Festival. 

17.11. Kapital is not responsible for damages that may occur outside the Festival Area or on the way to or from the Festival Area.

17.12. Kapital has the right to terminate with immediate effect the legal relationship with the Participant (having a Ticket or Bracelet) who has violated any provision of these GTCs in connection with the Festival. In such a case, Kapital may invalidate the Participant's Ticket or remove the Participant's Wristband, and the Participant will be obliged to leave the Festival. Also, Kapital reserves the right to refuse the purchase of a new ticket by the respective festival-goer, for the entire duration of the festival or, if he obtains a ticket to the Festival, to refuse his access to the Festival, without granting him any right of compensation. 

17.13. In addition to the immediate termination of the legal relationship with the Participant, Kapital has the right to subsequently refuse his/her access to the Festival. 

17.14. The participant consents to be granted such medical treatment as may be considered appropriate in case of injury, accident or illness during the Festival and completely exonerates Kapital and all persons participating in the granting of the respective medical treatment from liability for any such actions. 

17.15. In the Festival Area, first aid and medical assistance services will be provided continuously. Kapital is not responsible for the manner in which these services are provided. 

17.16. During the Festival there will be various high-intensity light shows and pyrotechnic effects that can harm children or epileptic people.

17.17. Participants who suffer from mental or physical illnesses and who may be affected in any way by loud noises, special visual effects, crowded areas, special sound effects or any other similar, assume full responsibility for the damages they may suffer.

17.18. Also, the Organizer does not assume responsibility for any damages or injuries that may arise as a result of fireworks. The participants assume full responsibility for the ability to participate physically/mentally in various activities within the Festival.

IMPORTANT! We recommend carrying out specialized medical check-ups before participating in activities that require an increased level of effort.

17.19. Kapital shall have no responsibility, of any kind, for any kind of damage (direct or indirect) resulting from the use or inability to use the information presented on the Site in connection with the Festival. Kapital, without any prior notice, may delete, modify or add any information to the Site, suspend any activity on the Site, and if references are made to other sites Kapital does not guarantee and/or confirm in any way the type of information that may be found on these sites. 

17.20. Kapital is also not responsible for the comments posted by users on the Site. Any information, data, text, photographs, graphics, etc. contained on the Site are the responsibility of that person/entity from whom it originates. Under these conditions, Kapital cannot guarantee the content of the Site including, but not limited to, truncated, incomplete or erroneous information or for any consequences of its use. 

17.21. Kapital makes no guarantees, of any kind, that the Site will operate uninterrupted, securely, and without errors of any kind. The site may be terminated by the owner or administrators at any time without any prior notice and without any claim of any kind on the part of its users. 

17.22. The value of the purchased tickets will not be refunded in the event of cancellation of the Festival by the Organizer due to force majeure or unforeseeable circumstances. Force majeure or fortuitous event means any external and unforeseeable event such as, but not limited to: storms, threats or risk of terrorist attack, acts of public authorities, whether legitimate or not, epidemics, pandemics, accidents, explosions, fires, floods, torrential rains, earthquakes, social conflicts, major short circuit, high risk of health damage or any other cases that cannot be foreseen or removed through diligence and prudence by the Organizer.

17.23. Moving the venue of the event to the same geographical area is not a reason for returning the value of the tickets.

17.24. The dates of the festival may be unilaterally modified by the Organizer in case of force majeure or unforeseeable event without any obligation to refund the price of the tickets to the Buyer.

17.25. In the event of the death of the ticket holder, the Event Organizer will refund the value of the paid ticket provided that the applicant presents the supporting documents proving the event (for example, death certificate). 

 

18. INTELLECTUAL PROPERTY RIGHTS  

18.1. Everything that is posted on the Site as well as on various types of media in the Festival Area, such as, but not limited to, images, texts, graphic elements, symbols, logos, databases, etc.   is the property of Kapital and/or its Contractual Partners. All of these fall under intellectual property law.

18.2. Visitors and Third Parties may not use, copy, distribute, publish or incorporate in other documents or materials such markings/information in any form for the purpose of obtaining income without the prior express written permission of Kapital and/or its Contractual Partners.

18.3. The images, logos, texts of Kapital's Contractual Partners belong to them and are reproduced on the Website or in the Festival Area with their consent.

18.4. Kapital will make every effort to identify the messages it has received on the Site without having been addressed to it, by restoring the direct link to the source or by mentioning the persons who appear on this Site, but it will not always be able to guarantee the existence of the source reproduced.

 

19. PROVISION OF INFORMATION/ATTEMPTED FRAUD

19.1. In order to use the Site, users of the Site agree to provide real information about themselves as specified in the registration section as a user and agree to provide this information correctly and completely.

19.2. Any attempt to provide false information, to access the personal data of another user, to modify the content of the Site or to affect the performance of the server on which the Site is posted, will be considered an attempt to defraud Kapital's systems and will lead to the immediate blocking of access to the Users of the Site. Kapital also reserves the right to notify the competent authorities of this attempt.

 

20. PROMOTIONAL OFFERS, SWEEPSTAKES, AND CONTESTS

20.1. Kapital, at its choice, will establish the conditions for conducting the promotions on the Site, under the conditions of the law. Promotions, sweepstakes and contests run for a limited period of time and automatically expire on the date specified for each promotion, sweepstakes or contest.

20.2. Any promotion, sweepstakes or contest may be discontinued or cancelled at any time without any prior notice. However, all participants will be notified of the interruption or cancellation.

 

21. CONFLICT

21.1. Any conflict arising between Kapital and its customers as a result of participation in the Festival or use of the Site shall be settled amicably. If this is not possible, the resolution of conflicts is the competence of the Romanian courts in Cluj-Napoca or Bucharest. 

21.2. The applicable law is Romanian law.

 

22. MISCELLANEOUS PROVISIONS

22.1. These Terms and Conditions, representing the Contract between the consumer and the Organizer, may be assigned by the latter without the need for the customer's consent.

22.2. Chapter names and subheadings are for reference only and shall not be taken into account in the interpretation or construction of these GTCs.

22.3. In the event that any of the clauses of this GTC are declared null or unenforceable, the rest of the clauses will continue to take effect, and the clause declared null or unenforceable will be replaced by a new clause that reflects as closely as possible the will of the Organizer.

  ANNEX 1  

ONE FOR ALL PASS 2026 Terms & Conditions
 

 

Definition

  1. One for All Pass is a multi-event voucher, purchased by the Buyer, which offers the possibility to participate only once in each of the following three events: UNTOLD 2026, KAPITAL 2026 and UNTOLD DUBAI 2026.
  2. The voucher does not constitute an access ticket at the time of purchase. It becomes a valid ticket only after registration (Redeem) made by the Holder, according to the conditions communicated by the Organizer.

 

Voucher registration 

  1. The Organizer reserves the right  to send the voucher for each festival no later than April 31, 2026, in the absence of exceptional circumstances that may determine the Organizer to postpone this moment.
  2. The holder is obliged to register the voucher received in his personal account (the Redeem action) so that it becomes a ticket itself. The registration of the voucher is done exclusively through the personal account on the Organizer's platform. Details regarding the Redeem operation can be found in the Terms and Conditions of each festival.
  3. After registration, the voucher is converted into a valid, electronically issued ticket, which becomes subject to the General Terms and Conditions (hereinafter "T.C.G.") of the respective edition.
  4. Failure to register the voucher by the start date of the event is equivalent to voluntary renunciation of participation in that event, without the possibility of modification, refund or postponement for future editions.
  5. Failure to attend any of the events does not entitle you to refunds or subsequent transfers.

Special features of Untold Dubai

3.1.  The component of UNTOLD Dubai 2026 is  not a valid ticket until the following conditions precedent are cumulatively met:

(a) obtaining the Authorisation to organise the event for the year 2026;

(b) the issuance and distribution of tickets through DTCM licensed entities and in accordance with the DET/DTCM rules;

(c) registration of the voucher by the buyer, according to Art. 2;

3.2. If the authorisation in point (a) is not obtained, only the component related to the Dubai event is refunded. Rescheduling the event does not entitle the holder to any further compensation, compensation or additional refunds.

3.3. The organizer of the event is Untold Dubai LLC, a company registered in the United Arab Emirates, and the UAE tax regime and VAT rate apply to this component. The invoice for the Dubai component is issued only when the voucher is converted into a valid ticket issued through the DET/DTCM system.

Online Check-in Obligation and FEES

  1. By holding a One for All Pass, the holder acknowledges and undertakes, according to the T.C.G. of each event, to carry out the Online Check-in free of charge, within 30 days from the registration of the voucher and its transformation into a ticket, for each event.
  2. After the expiry of this term, in order to carry out the Online Check-in, the holder will be obliged to pay the Online Check-in fee established by the organizer of the event, according to the values and conditions communicated in the related T.C.G.
  3. Check-in, editing or transfer fees may differ from one event to another and are those published in the T.C.G. of each festival.
  4. The organizers of the events in Romania are entities registered for tax purposes in Romania, part of the Untold Universe S.A. group, according to art. 1 of the Terms and Conditions, and the prices and taxes related to these events include VAT according to Romanian legislation.

 

  1. General characteristics
    1. Owning a One for all Pass (G.A.) product offers the buyer the same facilities as those related to a General Access (G.A.) ticket, but with the particularities exposed in this section.
    2. The product purchased by the consumer is subject to the same transfer, edit and top-up conditions, described in the GTC related to the 2026 edition of each festival.
    3. The right to participate in each festival included in the product can be transferred only once, through the official platforms approved by the Organizer. Resale, assignment or sale outside of official channels may result in the immediate cancellation of the voucher, without refund.
    4. The organizer will have the right to impose the exclusive use of a payment method for payments made within the Festival, which may have a different conversion rate than the national currency. The festival-goer will be provided with the right to buy this currency from a series of exchange points within the festival and/or directly from the application by accessing the online top-up facility.

 

  1. Reorganization of the event
    1. The value of the product is non-refundable. In the event of the definitive cancellation of one of the included events, a proportional refund is granted exclusively for the component related to the cancelled event.
    2. In the event that the event is cancelled or rescheduled due to external causes beyond the control of the Organizer, the serious fault of the Organizer or which falls under the scope of force majeure or unforeseeable circumstances, the owner will have the right to participate in the rescheduled edition (from the same year), or to the extent that the event could not be rescheduled in the same year,  The validity period of the voucher will be automatically extended with the period of a new edition.
    3. Force majeure or fortuitous event means any external event such as, but not limited to: storms, threats or risk of terrorist attack, decisions of public authorities, whether legitimate or illegitimate, epidemics, pandemics, accidents, explosions, fires, war, floods, torrential rains, earthquake, social conflicts, major short circuit, high risk of affecting the health of the population,  decisions of the authorities or any other cases that cannot be foreseen at the time of announcing the edition for the following year or removed by reasonable diligence and prudence by the Organizer.
    4. The organizer reserves the right to change the venue of the event to the same geographical area to the extent it deems it appropriate or necessary and to notify the buyers in such a case.
  2. Obligation to comply with the Terms and Conditions
    1. Holders of a One for All Pass voucher are obliged to comply with the T.C.G. established by the Organizers for each festival. The general terms and conditions are available to any Buyer at any time for consultation, on the www.untold.com, www.kapitalfestival.com and www.untold.ae website.
    2. The Organizer reserves the right to modify or change the T.C.G. and its Annexes, and such changes will enter into force only after the prior announcement of the presentation of these changes on the website.

 

  1. Protection of personal data 

8.1.  The data controller for the product ONE FOR ALL Pass is UNTOLD PRODUCTION SRL, a Romanian legal entity, part of the UNTOLD Universe.

8.2. For the issuance of the ticket related to the component UNTOLD Dubai 2026, certain personal data will be transferred to NEVERSEA PRODUCTION SRL And UNTOLD Dubai LLC, an entity registered in the United Arab Emirates, solely for the purpose of issuing tickets and validating access to the event.

8.3. The international transfer of data from the EU to the UAE relies on Standard Contractual Clauses (SCCs), additional technical and organizational measures and in accordance with the provisions of the GDPR and PDPL.

8.4. For detailed information on the purposes of the processing, categories of data, storage period, data subject rights and transfers, data subjects are requested to consult UNTOLD Privacy Policy.

 

  1. Governing Law and Jurisdiction

9.1. For UNTOLD Europe and KAPITAL events, Romanian law applies.

9.2.  For the UNTOLD Dubai component, UAE legislation applies.

9.3.  Any dispute related to the use of the voucher or the issuance of tickets will be resolved by the competent courts in Cluj-Napoca, Romania, for events in Romania; respectively by the courts of the Emirate of Dubai, for the Dubai component.
